Licensing Program Analysts (LPAs) Lilli Babcock and Mariah Aguirre conducted an unannounced follow-up complaint inspection to deliver findings on the above allegations. A COVID risk assessment was conducted. LPAs met with Director, Maribeth Peralta, to whom the reason for the visit was explained. Director guided LPAs on a tour of the facility. LPAs observed thirty-two (32) children and eight (8) staff present at the facility during this inspection.

During this investigation LPA Babcock conducted interviews with five (5) staff and six (6) daycare parents. LPA Babcock also obtained several documents related to complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), Personnel Report (LIC 500), and incident reports for Child #1 (C1).

Director stated she will have a training with staff regarding the facility procedure for diapering. Director states she will submit to licensing the agenda for the training, signed by all staff, as well as a detailed diapering plan for the facility.

Based on interview, the facility did not comply with the section cited above in 1 of 41 children in care whose diaper was put on too tight causing abrasions on sides of groin which poses/posed a potential health, safety or personal rights risk to persons in care.

According to the allegation a child in care received injuries due to a lack of supervision. During a visit conducted on 11/21/24, LPA Babcock observed facility camera footage which showed the toddler class outside on the toddler playground in real time. LPA watched the camera for the toddler playground for a total of 29 minutes and 6 seconds. During that time, there were three staff supervising the toddler playground. LPA Babcock observed Staff #1 (S1) either standing by the gate separating the toddler and infant playgrounds, standing with their back to the children, standing and talking with Staff #2 and Staff #3, or sitting on the playground slide for 20 minutes and 19 seconds, and was not observed to be walking or circulating around the playground for the entire duration of the 29 minutes and 6 seconds. Staff #2 was observed to spend 10 minutes and 3 seconds conversing with Staff #1 and/or Staff #3 with their back away from the children or standing at the gate. Staff #3 was observed to spend 15 minutes standing by the fence looking toward the preschool playground or speaking with Staff #1 and/or Staff #2. LPA observed several instances where staff did not have visual supervision of all children on the playground. Per Director, staff are required to be walking around and not remain stationary while supervising outside play time. During interviews conducted, Staff stated they have observed on several occasions staff “sitting near the gate or sitting inside the play structure, and not watching the children”. Staff stated, “They don’t see the children at all, they get injured, and they do not see it”.

Allegation #2: Staff did not properly strap diaper causing red marks

According to the allegation staff put a diaper on a child too tight which caused abrasions on the side of the child’s pelvis. During interviews Staff #4 (S4) stated, “I have seen teachers put on diapers too tight, causing red marks where the tab goes. I have seen this a few times”.

Based on interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
