On 1/29/25, Licensing Program Analysts (LPAs) Lilli Babcock and Monica Ruiz conducted an unannounced follow-up complaint inspection to deliver findings on the above allegations. A COVID risk assessment was conducted. LPAs met with Director, Maribeth Peralta to whom the reason for the visit was explained. Director guided LPAs on a tour of the facility. Census was taken. LPAs observed twelve (12) children with four (4) staff in the Infant Room, and sixteen (16) children with three (3) staff in the Toddler Room.

During this investigation LPA Babcock conducted interviews with twelve (12) staff including the facility director, and seven (7) daycare parents. LPA Babcock also obtained several documents related to the complaint allegations, including but not limited to, a copy of the Facility Roster (LIC 9040), and Personnel Report (LIC 500).

Allegation: Director changes incident reports-conduct inimical

According to the allegation, the facility director lied to licensing and makes changes to incident reports. During interviews conducted by LPA, all staff stated they have no knowledge of the director lying to licensing or making changes to incident reports that were untrue.

Allegation: Staff dropped children from changing table on several occasions

According to the allegation, two staff dropped children from a changing table and the incident was not reported. During interviews, two staff disclosed two separate incidents where an infant/toddler rolled off or fell off a changing table. In both instances the children were caught by the staff, did not hit the floor, were not hurt, and parents were notified. LPA discussed with director the importance of ensuring children’s safety during diaper changes. Parents interviewed stated they are happy with the care and supervision being provided to their children.

Allegation: Staff do not allow children to finish food and food is thrown away

According to the complaint, children are not allowed to finish their lunches, and teachers throw children’s lunches away so children can be put down to nap. During interviews conducted, all staff stated they have never heard of any staff throwing children’s food away and not letting them finish eating. Parents interviewed stated they are happy with the care and supervision being provided to their children.

Allegation: Facility gates are broken causing children to run into the road

According to the allegation, facility gates are broken, and children run out to the street. During interviews conducted, the Director disclosed that the facility entrance gate closest to the parking lot received

maintenance on 10/18/24 due to the push bar mechanism getting stuck, however staff stated there have been no infant/toddler children that have left the facility gates without supervision. LPA inspected the infant and toddler gates during visits on 11/26/24, 12/9/24, 1/9/25, and 1/29/25 and did not observe any gates to be broken.

Allegation: Playground is in disrepair

According to the allegation, the playground is not fixed well, and children are getting hurt. During interviews conducted, all staff stated they have no knowledge of the playground being in disrepair and if there is an issue with something needing repair the facility fixes or replaces it quickly. All staff stated they have no knowledge of any children getting hurt on the playground because it is not in good repair. LPA inspected the infant and toddler playgrounds during visits on 11/26/24, 12/9/24, 1/9/25, and 1/29/25 and did not observe any part of the playground to be in disrepair.

Allegation: Unqualified staff

According to the allegation, the facility has unqualified teachers and not enough staff. During the visit by LPAs on 11/26/24, all staff files were reviewed, and LPAs confirmed staff were qualified for their positions. During interviews, all staff stated they have not been out of ratio. Director stated, “we make sure we have hired enough staff”. During visits on 11/26/24, 12/9/24, 1/9/25, and 1/29/25, LPA Babcock observed the facility to be in ratio.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

There were no deficiencies cited on the above-mentioned allegation per California Code of Regulations Title 22.
A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
