32 | 16:57 (10:29:19 am) – A child is taken by the left forearm by S4 and walked to the changing table area. S4 is behind the child and grabs the child by the upper arms and pulls the child back toward the S4, setting the child on the ground and then S4 walks away.
18:00 (10:30:22 am) – a child is sitting on the floor by the changing tables and S4 straddles the child with staffs legs and reaches down to grab the child on both upper arms and picks the child up with their legs dangling and swinging and sets the child on the carpet.
Throughout the children’s time on the carpet, staff are constantly moving or sliding the children on the rug to have the children sit along the back or side edges of the rug. Children are not able to get up, lay down, or move away from the rug without being brought back to the rug area and put in a seated position. Throughout the video, staff pull the children’s arms to stand them up or pull the children’s arms to move them to where staff want them to be, or sit children down in a harsh manner. During interviews conducted by LPA, Staff were shown video footage of some of the instances listed and staff stated the instances should not have happened.
Staff interviewed stated the toddlers are to remain on the rug during circle time and are not allowed to walk away from the rug during circle time. Per the Toddler Daily Schedule obtained from Director, Circle Time is from 9:30 am – 10:00 am, however video footage shows Circle Time on 4/10/25 to be from 10:00 am – 10:49 am.
Based on interviews conducted and video footage obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D.
LPA Babcock informed facility representative, Maribeth Peralta that this report dated 6/17/25 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
