Licensing Program Analyst (LPA) Warren Birks conducted an unannounced complaint inspection to deliver a finding for the above allegation. LPA met with Licensee Jolandra Navarre who assisted with the inspection.

During the investigation LPA conducted interviews with children and staff. LPA also observed written Licensee correspondence. Based on evidence obtained including interviews and written correspondence, the allegation is substantiated. LPA recieved corroborating disclosure (includes Licensee disclosure and written correspondence) that Licensee Navarre tapped child #1's hands with a foam sandal as a form of discipline. LPA received staff disclosure that child #1 spit on staff #1 and child #1 was separated from the other children to think about that behaviour. The Licensee indicated child #1 began kicking a door and she went to talk to child #1 and the child grabbed her foam sandal and began flailing the sandal around. The Licensee indicated she took back her foam sandal and tapped the child's hands to say no. The Licensee indicated she could not get the behaviour under control. The Licensee and staff indicated that the tap from the foam sandal caused no physical harm and the intent was not to cause physical harm and there was no injury. CONTINUED.

LPA informed Licensee that the department has correspondence which indicates the Licensee asked the child if she would like to call the police and tell them about the behavior. The Licensee informed LPA that she asked the child if the child wanted her to call the police to prevent the child from exhibiting the previous behavior (because he is scared of the police). However, she was never going to call the police.

Note: The allegation was described as child was first provoked by his food being threatened to be taken away. Staff indicated the food fell on the floor and needed to be discarded which was the reason the child was upset. LPA could not determine if that happened or not. However, LPA informed Licensee that the facility will be cited as the tapping of the child's hands with a foam sandal and threatening to call the police on the child is a Personal Rights violation of Title 22 regulations.

LPA informed Licensee that she needs to implement "Title 22 Compliant" options when dealing with child behavior. LPA advised Licensee to review Child Care Licensing video "Children's Personal Rights in Childcare" at: ccld.childcarevideos.org

Based on staff interviews and written correspondence, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

A copy of this report must be provided to the parent or guardian of every child and (including any newly enrolled children) for the next 12 months. The Acknowledgement of Receipt (LIC 9224 form must be maintained in each child’s file immediately upon receipt from parent/guardian). Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) form.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. This report along with a copy of the appeal rights was provided. Exit interview was conducted with Licensee Jolandra Navarre.

Licensee Navarre indicated she and all staff will watch CDSS video on Children's Personal Rights in Child Care and have all staff including herself review Title 22 Personal Rights regulations. Licensee will provide a written form to LPA with staff signatures indicating staff watched video and reviewed Personal Rights regulations.

humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Disclosure and written correspondence indicated Licensee tapped child #1 on hands with a foam sandal and threatened to call the police on child #1. This is an immediate risk to children in care.
