Licensing Program Analyst (LPA) Anthony Padilla conducted an unannounced annual inspection to the above facility on 07/19/2024. LPA arrived at the facility at 12:15 PM and met with Licensee, Aracely Flaharty, Licensee who guided analyst on a tour of the facility. Also present during this inspection, was, Licensee’s Assistant, Gabby Flores. Entrance Checklist for Family Child Care Homes was provided to the licensee upon entry. Per Licensee, there are 14 children that are currently enrolled. A current children’s roster was available for review. There were 10 children present upon arrival.

This is a single-story home which consists of three bedrooms, two bathrooms, family room/child care, kitchen, dining room, living room, and backyard (fenced). LPA observed outdoor play area (backyard) to be safe. Backyard is adequately fenced. LPA observed a fish pond in the backyard. The fish pond is surrounded by an iron fence. The fence is designed and installed so that children are unable to remove it. LPA did not observe gaps providing direct access to the fish pond. Areas off limits include: Bedroom number three located next to the backyard. LPA observed the bedroom to be locked. LPA observed the room is being used as an office and storage. Areas used by children include: two bedrooms, bathroom located inside the house, family room/day care room located towards the back of the backyard, bathroom located inside of the family room and backyard (fenced). All off-limit areas need to be made inaccessible to children in care. The licensee understands that licensing staff may have access to off-limit areas during inspection visit if necessary.

Individuals who reside in the home were noted and discussed. All adults present in the home have obtained a criminal record clearance. Licensee states that there are no firearms stored in the home. LPA did not observe any fire arms at facility during inspection.

At 12: 40 PM all areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a landline and cell phone that is used, and the cellphone stays at the facility during operation hours. Safe toys play equipment and materials were observed. Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children. LPA observed them to be stored in the hallway cabinet with a child safety lock. The licensee states that there are no poisons in the home and understands that storage areas for poisons must be locked with a key or combination lock. The restroom that children use was observed to be safe and sanitary.

The valve on the required 2A10BC fire extinguisher indicates fully charged and was serviced on 01/10/24, as indicated on service tag. Smoke and carbon monoxide detectors were not tested due to children napping. LPA observed light on of carbon monoxide machine that is operable operable. LPA observed them in the living room.

Licensee states that she is currently caring for 1 infant. Licensee states that the infant naps in the crib located in the bedroom next to the kitchen. Licensee stated that she keeps the bedroom door open when the infant is napping in the bedroom. Appropriate sleeping arrangements were observed. Licensee was advised cribs or play yards cannot hinder the entrance or exit from the sleeping space, mattresses shall be firm and covered with a fitted sheet that overlaps the underside, so it cannot be dislodged. Licensee was advised cribs and play yards must be free of loose articles and objects.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys, climbing structure, swing set, soft cushions to absorb impact if a child falls to prevent serious injury, and other materials for children to play with. The licensee states that supervision is always provided.

The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 03/2025. There are first aid supplies available in the hallway cabinet. LPA advised that if a child shows signs of illness he/she/they shall be separated from other children in licensee on limit bedroom separate from other children in care.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. At 1:00 PM LPA observed the last drill documented was conducted on 5/31/24.

At 1: 10 PM LPA observed Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were posted. LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility. Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

At 1:15 PM Children’s and staff records records were reviewed, including emergency information and were observed to be complete. The licensee has proof of immunization against influenza, pertussis, and measles. LPA observed that the Licensee and assistant have a current Mandated Reporter AB 1207 Compliant Child Care Training Certificate on file. LPA issued a Confidential Names List (LIC 811) to the licensee which documents staff and children’s files reviewed during this inspection.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.  Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

At this time, the licensee is in compliance with California Title 22 Regulations. Therefore, there are no citations being issued today.

During the exit interview, the LICENSEE Araceli Flaharty, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was given and must remain posted for 30 days.
