Licensing Program Analyst (LPA) Saul Valenzuela conducted a subsequent inspection to a complaint investigation. Upon arrival at 2:00 p.m., LPA met with Director Jazmin Manzanero, to whom the purpose of the inspection was explained. A tour of the facility was provided. Census was taken. There were 44 children with 9 staff members.

During the course of the investigation, interviews were conducted with 3 staff members and 3 parents. Documentation in the form of Child Care Facility Roster, Personnel Report, Parent Handbook, Email threads, student conference notes, ouch reports, and tuition forms were obtained.

According to the allegation, Facility is retaliating due to child’s behavior.

During interviews with staff, LPA asked Staff #1 (S1) if a child has been removed from the school and S1 stated that Child #1 (C1) termination from the school has been due to behavior stating that "we exhausted our resources ", and non-payment of tuition for July through September. Staff corroborated that C1's behavior have been address in the past with legal guardian during student conferences. According to S1 that C1 is no longer receiving subsidies for tuition and the copay for the month of October has not been paid at the time of the investigation.

During the investigation LPA reviewed C1’s file and observed that there was an outstanding tuition balance for the month of July through September. LPA reviewed the Tuition Agreement signed by C1’s legal guardian stating that “(1) Non-payment of Tuition for a period of 1-week or more from due date” and "(2) Child continues behavior that poses safety risks..." are grounds for termination. LPA observed student conference notes for C1 with S1, S2, S3 and legal guardians.

Parents made no disclosures regarding the above allegation.

This agency has investigated the complaint alleging facility is retaliating due to child’s behavior. Based upon the evidence as presented above, the allegations have been determined to be Unsubstantiated.
A finding of Unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegations are unsubstantiated.

There were no deficiencies cited on the above-mentioned allegation per California Code of Regulations Title 22.

A notice of site visit was given and must remain posted for 30 days.
