Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Director Esther Choe.

During the course of this investigation, LPA Lee conducted interviews, reviewed documents, and made observations in regards to the above allegation.

The complaint alleges that Child#1 who is a toddler over 2 years old was being cared for in the infant classroom. Child#1 has a younger singling, Child#2, who is an infant enrolled in the infant care program. The reporting party stated that during pick up time, Child#1 was in the infant room with Child#2 during pick up time. During the course of this investigation, LPA Lee conducted two prior inspections in different times in the afternoon. During the two prior inspections and the inspection conducted on this date, LPA Lee did not observe Child#1 in the infant room. Child#1 was observed in a preschool classroom.

The facility denied this allegation and made no disclosure. It is still possible that Child#1 was being placed in the infant room during pick up times, however LPA Lee did not observe anything during the unannounced inspections of the infant classroom. The facility was advised that children from the infant program and preschool program cannot co-mingle even if the children from separate programs are siblings.

Based on the evidence collected during the investigation, the allegations that facility commingled children may be valid. However, there is not enough preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegations are found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
