At 8:50 am Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced required annual/random inspection to the above facility. A COVID risk assessment was conducted upon entry and appropriate PPE was used by LPA. LPA met with Licensee, Angelina Ramirez, to whom the reason for the visit was explained. Per Licensee, there are 10 children currently enrolled. There were 3 children and 3 adults present upon arrival. The licensee was observed to be operating within the license capacity limitations.

The licensee states that 4 adults and no children currently live in the home. Per Licensee, there is one assistant in the facility. All adults living in the home have obtained a criminal record clearance.

This is a one-story home which consists of 4 bedrooms (1 which is the chid care nap room), 3 bathrooms, 2 living rooms (1 is a childcare room), dining area, kitchen with laundry room, detached garage, front yard, and backyard with swimming pool.

Child care areas: 1 child care nap room, 1 living room used as day care room, 1 bathroom, and a portion of the backyard not including the pool. Per licensee, the children never enter the swimming pool area.

Off limit areas: 3 bedrooms, 2 bathrooms, kitchen with laundry room, dining area, living room located next to the kitchen, inaccessible storage room and garage, and pool area which is fenced.

Licensee guided analyst on a tour of the facility at 8:55 am. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed: the door to the children's restroom was locked from the inside and Licensee was not able to unlock door until 5th attempt. LPAs recommended licensee remove lock from children's bathroom door. LPAs observed the door leading to off limit adult restroom and bedroom was shut but not locked. LPAs inspected area and recommended licensee add child proof door knob to make area inaccessible to children in care.

Facility License, Emergency Disaster Plan, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. A current children’s roster was available for review. There is telephone service via a cellphone that stays at the facility during operation hours. Hours of operation are Monday – Friday,6am-6pm. There is ventilation and central heating in the home. LPAs observed a fireplace in the living room that is inaccessible to children.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per licensee there are poisons in the home which are inaccessible to children in off limit laundry room which is locked with key lock. LPAs advised that any poisons should be locked under key or combination lock. Licensee states that there are no firearms or weapons stored in the home.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 6/22/2023, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable on this day.
All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 03/1/2024.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children. Appropriate sleeping arrangements in form of cots were observed.
Licensee states that she is currently caring for one infant, aged 23 months. LPAs did not observes a sleep log and sleeping plan for the infant. Licensee states that she does not log sleep every 15 minutes.

Currently, children are using a portion of the back yard (not including pool area) for outdoor play time. The outdoor play area was observed to be fenced. LPAs observed that the outdoor yard has toys and other materials for children to play with.LPAs observed an in ground pool in the off-limits portion of the backyard. On limit and off limit parts of the backyard are separated by a metal fence with 2 gates leading to pool area.LPAs observed operating gates that swing away from the pool, self-close and are self-latching. The back off limits portion of the house has 6 windows and one set of French doors that lead directly to the pool area, however licensee installed a mesh fence that wraps around the pool on the right side of the pool to the block wall of the property. The left side of the pool area beyond the metal fence has a block wall. The pool was observed to be inaccessible by a 5-foot mesh fence that surrounds the pool.

LPAs observed that fence does not obscure the pool view Licensee agrees on this report that the fencing will remain in place whenever licensed care is provided, and so long as the mesh fence makes the swimming pool inaccessible to children as determined by licensing staff.

Children’s records were reviewed, including emergency information and were observed to be complete. LPAs reviewed records for infant in care and did not observe immunization record for the infant.

Licensee and staff records were reviewed. The licensee and other personnel have completed Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 3/30/26. Mandated Reporter Training for licensee expires on 3/30/26. LPAs did not observe immunization record for assistant.

LPAs issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

There are 1 cat and 1 bird on the premises. Per licensee, the cat and bird is kept in the off-limits part of the home during daycare hours.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPAs did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee Angelina Ramirez, confirmed that there are no Registered Sex Offenders living in the facility and LPAs completed the RSO profile in FAS.

Based on the LPAs observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
A notice of site visit was given and must remain posted for 30 days.
