32 | Allegation: Staff did not ensure facility was maintained in a sanitary condition
According to the allegation, multiple children at the facility were ill with symptoms of fever and vomiting during at the beginning of August 2025 and the facility had outbreaks of pink eye, hand, foot, and mouth and pneumonia in the last year. The allegation stated the facility does not have proper sanitation practices.
During the investigation, LPA reviewed the facility Staff Handbook. The Staff Handbook states the facility uses a "bleach and water solution on hand washing sinks, toilets, and other surfaces that need disinfecting". During interviews staff and Director reported Staff #4 cleans the children's bathroom at the facility. Staff #4 stated "I use water and soap for the floors and for the bathrooms I use hot water with soap every day". When asked by LPA if Staff #4 uses bleach or another cleaning agent other than soap and water in the bathroom, Staff #4 stated, "No, I am allergic to those kinds of products".
The Centers for Disease Control and Prevention states the key steps for cleaning and disinfecting bathrooms is to first clean with soap and water and then to disinfect. As staff interviews conducted revealed the facility cleaned the bathrooms with only soap and water and did not disinfect the bathroom used by children, staff did not ensure the facility was maintained in a sanitary condition.
Based on LPA interviews which were conducted and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, are being cited on the attached LIC 9099D.
A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
