Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced Case Management inspection due to an incident that occurred on 10/12/23 and was reported to the Department on 10/13/23. A COVID risk assessment was conducted. LPA met with Director, Christina Gudino to whom the reason for the visit was explained. Director guided LPA on a tour of the facility. Census was taken. There were 6 staff present caring for 43 children. The facility was observed to be operating within the license capacity limitations.

On October 13, 2023, an unusual incident report was made to the Department regarding an incident that involved a child who sustained an injury that required medical attention. The facility reported this incident to the Department within the required 24 hours. Based on information obtained from staff declarations, LPA Babcock determined that during outdoor play on 10/12/23 at approximately 9:50 am, Child #1 (C1) jumped from the platform above the green stairs on the play structure onto the rubber chips covering the ground. C1 landed on his right wrist and was reluctant to move it after he jumped. First aid in the form of an icepack was administered, and parents were notified of the incident. During the visit LPA interviewed C1. C1 showed LPA what occurred during the incident and explained how C1 jumped from the platform onto the rubber chips and landed on the right wrist. LPA observed C1 was wearing a wrist brace on this day. At 10:20 a.m. during this inspection, LPA inspected the outdoor area and did not observe any hazards near or on the area where incident took place. LPA observed the ground under and around the play structure to be covered with rubber chips to help cushion a fall.

Based on declarations from staff, there was adequate supervision (3 staff and 20 children) at the time of the incident. It appears that although staff were present, they could not prevent the injury. C1 was taken for medical treatment and per the medical report which LPA received from the facility, C1 sustained a buckle fracture to the right wrist. Child has returned to day care.

Based on information obtained during this investigation, no additional follow up is necessary regarding the incident reported. The facility followed all proper procedures; staff administered first aid, child’s parents were notified, incident report was sent in properly and timely, and all medical needs were met.

No deficiencies are being cited at this time.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
