1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25	At 8:45 am Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced Case Management – Licensee Initiated visit to the above facility for the purpose of evaluating the Licensee’s request for a capacity increase from 8 to 14. Fire clearance for a capacity of 14 was granted on 10/18/24. A COVID risk assessment was conducted. LPA met with Licensee, Esther Gamboa, to whom the reason for the visit was explained. Per Licensee, there are 8 children currently enrolled. There were two children and Licensee’s Assistant present upon arrival. The licensee was observed to be operating within the license capacity limitations. The licensee states that 3 adults and 2 children currently live in the home. All adults living in the home have obtained a criminal record clearance. This is a one-story home which consists of 3 bedrooms, 2 bathrooms, living room, dining room/playroom area, kitchen, attached garage/laundry room, front yard (fenced), and backyard with pool (fenced). Per licensee, areas off-limits to children and parents include 2 bedrooms, 1 bathroom, kitchen, and attached garage/laundry room. The children have access to dining room/playroom, one bathroom, 1 bedroom, living room, backyard and front yard which are fenced. Licensee guided analyst on a tour of the facility at 9:15 am. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected. The following was observed: Facility License, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. There is telephone service via a cellphone that stays at the facility during operation hours. Hours of operation are Monday – Sunday, 5:00 am- 9:30 pm. There is central air and heating in the home.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per Licensee any poisons are stored in Rubbermaid storage container with keylock. LPA advised that any poisons should be locked under key or combination lock. Licensee states that there are no firearms or weapons stored in the home, and none were observed on this day.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 3/27/24, as indicated on service tag. Smoke and carbon monoxide detectors were tested and were operable on this day.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 10/17/24.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children. Appropriate sleeping arrangements in form of 2 pack and plays and 1 crib were observed.

Licensee states that she is currently caring for two infants (grandson and great-granddaughter). LPA observed sleep logs for the infants.

Currently, children are using the front yard for outdoor play time. Licensee requests to use the back yard as well as the front yard beginning on 10/23/24. The front yard play area was observed to be fenced. LPA observed that the outdoor front and back yards have toys and other materials for children to play with. A fireplace was observed in the living room. Fireplace has a glass screen which is zip tied together and is inaccessible to children. LPA observed an in-ground pool in the backyard. The pool was observed to be inaccessible by a 5-foot mesh fence that surrounds the pool. LPA observed that fence does not obscure the

pool view. There are 2 windows and 1 sliding glass door leading to the backyard but not directly to the pool. Both windows and sliding door have working alarms that were tested on this day and were operable. LPA observed the pool gate swings away from the pool, self-closes and is self-latching. Pool gate was observed to be locked with a key lock on this day. Licensee agrees on this report that the fencing will remain in place whenever licensed care is provided, and so long as the mesh fence makes the swimming pool inaccessible to children as determined by licensing staff.

Children’s records were reviewed, including emergency information and were observed to be complete.

Licensee and staff records were reviewed. The licensee and other personnel have completed Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 3/6/25. Mandated Reporter Training for licensee expires on 1/22/26.

There are 3 dogs on the premises. Per licensee, the dogs are kept outside in the off-limits front yard or off-limits side of the home during daycare hours, and the dogs will never be in the same area as children in care.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee Esther Gamboa, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

At this time, the licensee is in compliance with California Code of Regulations Title 22. No deficiencies cited.

The capacity increase request for a Large Family Child Care will be submitted for review. Once a capacity increase is issued, the Licensee is required to adhere to the terms and limitations as stated on the license.

A notice of site visit was given and must remain posted for 30 days.
