Licensing Program Analysts (LPAs) Saul Valenzuela and Roxana Lopez conducted an unannounced follow-up complaint inspection to deliver findings on the above allegations. LPAs met with Licensee, Cynthia Flores, to whom the reason for the visit was explained. Licensee guided LPAs on a tour of the facility. LPAs observed 10 children, Licensee, and Licensee’ two assistants present at the facility during this inspection.

During this investigation LPAs conducted interviews with Licensee, staff #2, 2 children, and 1 daycare parent. LPA Valenzuela also obtained several documents related to complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), declarations from licensee and staff #2, and copies of text messages.

According to the allegation # 1 Licensee does not provide adequate transportation for the day care children and allegation # 2 adult leaves day care child at school.

The licensee disclosed that on May 21, 2024, they told Staff #2 to leave child #1 at school due to behavior issues. The licensee told Staff #2 that they would contact child #1’s parent and have them pick up the child from school. Per Licensee, they do not have a written transportation contract on file and Licensee stated " It was all verbal agreement with parents and I am not charging them".

Staff #2 returned with child #2 to the day care home, leaving child #1 at school for the parent to pick up. The licensee stated that she has told Staff #2 in the past to leave child #1 at school for the parent to pick up child due to behavioral issues. Staff #2 confirmed that “this is not the first time this has happen plenty of times” where child #1 was left at the school for the parent to pick up. Child #1’s parent also confirmed that child #1 has been left at school “four or five times before” and that school officials would notify the parent that child #1 was not picked up by day care staff.

Declarations obtained from the Licensee and Staff #2 documents that child #1 was left at school and parent was notified via text message.

Based on interviews conducted by the LPA and the licensee’s own statements, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & chapter 1), are being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of
$100.

An exit interview conducted, and the report was reviewed with Licensee, Cynthia Flores.

Per Licensee, she will update the contract to add a transportation agreement and have parents signed updated contract. Licensee states that she will not leave child at school behind. Per licensee, she will review Child Care Licensing DIvision resource videos and submit to LPA by 8/19/024.
