During staff interviews, Staff #1 reported that incidents involving Child #1 did not require medical attention and therefore were not reportable to licensing per Title 22 regulations. Staff confirmed that they did communicate incidents with families when necessary. As well as S#2-S#5 stated that no incidents required medical attention.
Parent interviews did not result in any disclosures supporting this allegation. Parents interviewed stated that they are satisfied with the care and supervision that is provided by the facility and had no concerns.
During LPA’s observations and file review, LPA Perry did not observe any incidents that were documented that required medical attention. LPA Perry reviewed Title 22 regulations for reporting requirements with Director Dominic and director understood.
ALLEGATION 2: Staff do not provide a safe environment for children in care
The reporting party alleged that Child #1 displayed aggressive behaviors, including biting, hitting, and pushing other children into walls, and claimed that administration was aware but did not address the behavior.
During interviews, Staff #1 and Staff #2 acknowledged the behavior concerns with Child #1 and stated that they had ongoing communication with the child’s family to seek strategies and support Child #1. They also reported that efforts were made to ensure the safety of other children in care and to provide Child #1 with the appropriate environment and support. S#3-S#5 stated that redirection was used to help prevent incidents from occurring. Staff #1 stated that behavior support plans or interventions have been implemented and stated that, “Teaching Team meetings. Advocacy that teaching team attendance be consistent to work with child.”
Parent interviews did not disclosure any relevant to this allegation. Parents interviewed stated that they are satisfied with the care and supervision that is provided by the facility and had no concerns.
Based on interviews, observations and disclosures made during the department’s investigation, no disclosures were made by staff or parents pertaining to the allegations above, “Staff do not report incidents to appropriate parties” and “Staff did not provide a safe environment for children in care”. Therefore, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. |
