At 8:45 am Licensing Program Analysts (LPA’s) Roxana Lopez and Lili Babcock conducted an unannounced case management licensee initiated inspection to the above facility on 10/15/2021. A risk assessment was conducted upon entry- appropriate PPE was used. LPA met with Margaret Soto, Licensee, who guided analyst on a tour of the facility. The purpose of this inspection is due to licensee’s request for a capacity increase on 8/17/2021. Currently, the licensee’s capacity is eight. Licensee wishes to increase to a capacity of fourteen. Per Licensee, family members residing in the home are 2 adults and 1 child. Per licensee, operation hours will be Monday to Friday 6:00AM to 8:00PM. There were 4 infant children present upon arrival. Also present during inspection was Licensee’s husband. A current children’s roster was available for review.

All areas identified on the facility sketch were inspected, including but not limited to, off limit areas. This is a one-story home which consists of 5 bedrooms, 3 bathrooms, 2 kitchens, dining room, 2 living rooms, laundry room, front yard and backyard (fenced). The home is split in half indoors.

Per Licensee, main care areas include the front portion of the house which consist of a living room, 2 bedrooms 1 bathroom, laundry room, kitchen and left side of back yard fenced. Kitchen area has a baby gate making it inaccessible for children in care. Areas that will be used by children were inspected for safety, comfort, cleanliness, telephone service via house phone and cell phone is available, ventilation in form of AC was observed. LPA did not observed a fireplace or wall heater . Detergents, cleaning compounds, medicines, sharp objects and hazardous items that can pose a danger to children are inaccessible in areas designated for children. The Licensee states that there are no poisons at the facility. The Licensee was advised that any poisons must be locked with a key or combination lock. The valve on the 2A10BC fire extinguisher indicates charged, however Per Licensee, she has it since first Licensed on 1/2020. Smoke and carbon monoxide detectors were tested and are operable. Fire/disaster drill log was also current, last drill conducted on 09/17/2021.

Based on the Facility Sketch submitted, areas off limits to children and parents are: The back half of the home which consists of 3 bedrooms, 2 bathrooms, kitchen, living room, and backyard. Front yard is also off limits. Licensee states that the door leading to the back of the house will stay locked during the hours of operation. The Licensee understands that licensing staff may have access to off-limit areas during inspection visit if necessary.

The children will use the left side of the yard for outdoor play, which was observed to be fenced. At 8:58 am LPA’s observed a rain gutter down spout. exposed with sharp edges, exposed nails and 2 water hoses on the grass. LPA’s did not observed any toys for children to play with. Per Licensee, she takes balls and other toys when she goes outside and is in process of buying outdoor toys.

Per Licensee, there is 1 pet in the facility. The dog is kept in the off limits backyard.

The Licensee states that there are no firearms, weapons or bodies of water on the premises. LPA’s did not observed any bodies of water.

There are toys available for children. The Licensee does not provide food for children in care. If food is not provided and food is brought from the children’s homes; container shall be labeled with child’s name and properly stored or refrigerated.

All required postings were observed. Children’s records were reviewed and are complete.
For assistance licensee has an assistant on file currently working on required trainings. Per Licensee, she currently has 6 children enrolled and will not enrolled any other children until assistant is fully trained and ready to work; Licensee have completed required Pediatric First Aid and CPR which training which expires, 1/2023 and the Mandated Reporter Training. Licensee and assistants have required immunization's. There are first aid supplies available.

Children nap on cots and in play pens in the bedrooms. Licensee states that she is currently caring for infants. LPA also informed licensee Margaret Soto of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed: For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm This facility currently does not have any children on medication.

Health and Safety Code 1596.7996 Effective January 1, 2019, CCC's and FCCH's are required to provide parents and guardians of children enrolled, enrolling or re-enrolling in care with written information on the risks and effects of lead exposure, blood lead testing requirements and recommendations and options for locations of affordable blood lead tests. 2019 Lead flyer Provided.

Licensing staff consulted with licensing regarding COVID-19 health and safety guidelines on this date, Licensing staff emailed COVID- 19 postings to Licensee posted on this date. There is no RAST inspection on file- LPA's discussed the self-assessment guide on this date. During this inspection LPA' discussed Social and Physical Distancing Guidance And Healthy Practices For Child Care Facilities In Response To The Global Coronavirus (COVID-19) Pandemic Written In Collaboration With The California Department Of Education.

Licensee is seeking to provide care for 14 children 3 months -12 years old. A fire clearance has been granted as of 8/27/2021.

Based on the LPA’s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

Based on LPA's observations during the backyard inspection. LPA's observer an accesible sharp rain gutter downspout- exposed nails and two unravelled hoses on the grass. This poses a potential risk for the health and safety of children in care.
