Licensing Program Analyst (LPA) Anomeh Eivazian conducted an unannounced complaint inspection in regards to the above allegations. LPA arrived at 8:40 a.m. on 11/02/2023. LPA met with Enereyda Flores, director who guided analyst on a tour of the facility. During this inspection total of 21 children were present in the facility with four staff.

During this inspection, LPA conducted interviews with three staff. During this investigation LPA Eivazian also conducted interviews with complainant and co-complainant.

Based on interviews that were conducted with complainant and co-complaiant, on 10/19/23, staff#1 was obseved to life a child from ground from armpits and forcefully place child on a chair and yelled twice " Don't go under the table".

Based on an interview that was conducted with staff#1, (date unknown), while staff#1 was in the classroom alone with her group, children were attempting to go under the table. Per staff#1, she asked children to stop to go under the table, but children did not listen to her. Per staff#1, child#1 was going under the table, staff#1 lifted child#1 from armpits and placed child#1 on the chair to prevent child#1 to go under the table, and told child#1 in a louder voice, do not go under the table. Per staff#1, she tapped on her hand on the table and said: " sit and draw". Per staff#1, she did not slam on child#1's hand.

Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegations are found to be Substantiated at this time. California Code of Regulations, 101223 (a) (2)--Personal Rights-- (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs are being cited on the attached LIC9099D.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the Bhagya Fernando, CEO/Owner of facility at 12:10 PM.
