32 | Based on an interview that was conducted with staff#1, (date unknown), while staff#1 was in the classroom alone with her group, children were attempting to go under the table. Per staff#1, she asked children to stop to go under the table, but children did not listen to her. Per staff#1, child#1 was going under the table, staff#1 lifted child#1 from armpits and placed child#1 on the chair to prevent child#1 to go under the table, and told child#1 in a louder voice, do not go under the table. Per staff#1, she tapped on her hand on the table and said: " sit and draw". Per staff#1, she did not slam on child#1's hand.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegations are found to be Substantiated at this time. California Code of Regulations, 101223 (a) (2)--Personal Rights-- (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs are being cited on the attached LIC9099D.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
