32 | during transition from inside to outside, and child#1 was throwing chairs down and had thrown himself on the floor where staff#4 picked child#1 up from underarms at which time the bruise would have occurred as child#1 was resisting.
Based on an interview that was conducted with staff#2, on 06/23/25 staff#2 observed child#1 had hard time during transition from inside to outside, and child#1 had thrown himself on the floor, and staff#4 had picked child#1 up from underarms. Per staff#2 during nap time, staff#2 observed bruise on child#1 right arm during nap time.
Per staff#1 and staff#3 interviews, pictures from child#1 arm was sent to child#1's parent on 06/23/25.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated at this time. California Code of Regulations, 101223 (a) (2)--Personal Rights-- (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs are being cited on the attached LIC9099D.
LPA Eivazian informed licensee, Shamalie Goonerwardene that this report dated 07/02/25 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Eivazian informed the licensee, Shamalie Goonerwardene to provide a copy of this licensing report dated 07/02/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
