Allegation #1: Facility is out of ratio.
According to the allegation, the infant program has been out of ratio during the month of August. Interviews conducted and documents reviewed by LPA revealed the following:

Staff #1 stated they observed the infant program to be out of ratio on August 16, 2022, for approximately 20 minutes. In addition, the Child Supervision Record (CSR) obtained by LPA for August 16, 2022 shows there were 6 infants signed into the infant room for the time period of 6:33 am – 7:40 am and only one staff was present from 6:30 am to 7:49 am, which indicates they were out of ratio.

Lastly, during interviews conducted, Staff #2 stated the infant program was out of ratio “4-5 times” during the month of August. Staff #1, Staff #2, Staff #3, Staff #4, and Staff #5 stated staff either “walkie” or “send a group text on the Group Me app” to signal their capacity and to notify staff if they are going to be over ratio. The Department received screenshots of the text stream on the Group Me app for the infant program, which showed the following:
8/1/22 at 8:29 am, the ratio was “6:1”
8/2/22 at 8:44 am, the ratio was “5:1”
8/15/22 at 7:43 am, the ratio was “5:1”
8/16/22 at 7:41 am, the ratio was “6:1”
8/22/22 at 8:11 am, the ratio was “5:1”
8/24/22 at 7:57 am, the infant room had a ratio of “1:6”
9/7/22 at 7:53 am, the infant room had a ratio of “5:1”

Based on the information gathered, and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22 Chapter 1 is cited on the attached 9099D.
No deficiency cited. Please see the complaint control number: 33-CC-20220825104159. The facility was cited for being out of ratio during the same time frame.

A Notice of Site Visit was provided and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
An exit interview was conducted, and the report was reviewed with Director, Jamlia Rivers.
