Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced follow-up complaint inspection to deliver findings on the above allegations. A COVID risk assessment was conducted upon entry and appropriate PPE was used. LPA met with Infant Director, Jamlia Rivers, to whom the reason for the visit was explained. LPA observed seven (7) children and two (2) staff present at the facility during this inspection.

During this investigation, LPA Babcock conducted interviews with the Senior Director and five (5) staff. LPA Babcock also obtained several documents related to the complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), Personnel Report (LIC 500), copies of Child Supervision Records (CSRs), staff time cards, and a copy of the Group Me Infant Chat from 8/1/22 to 9/7/22.

Allegation #1: Facility is out of ratio.
According to the allegation, the infant program has been out of ratio during the month of August. Interviews conducted and documents reviewed by LPA revealed the following:

Staff #1 stated they observed the infant program to be out of ratio on August 16, 2022, for approximately 20 minutes. In addition, the Child Supervision Record (CSR) obtained by LPA for August 16, 2022 shows there were 6 infants signed into the infant room for the time period of 6:33 am – 7:40 am and only one staff was present from 6:30 am to 7:49 am, which indicates they were out of ratio.

Lastly, during interviews conducted, Staff #2 stated the infant program was out of ratio “4-5 times” during the month of August. Staff #1, Staff #2, Staff #3, Staff #4, and Staff #5 stated staff either “walkie” or “send a group text on the Group Me app” to signal their capacity and to notify staff if they are going to be over ratio. The Department received screenshots of the text stream on the Group Me app for the infant program, which showed the following:
8/1/22 at 8:29 am, the ratio was “6:1”
8/2/22 at 8:44 am, the ratio was “5:1”
8/15/22 at 7:43 am, the ratio was “5:1”
8/16/22 at 7:41 am, the ratio was “6:1”
8/22/22 at 8:11 am, the ratio was “5:1”
8/24/22 at 7:57 am, the infant room had a ratio of “1:6”
9/7/22 at 7:53 am, the infant room had a ratio of “5:1”

Allegation #2: Facility commingled day care children.
The complaint alleges infants and preschool children were cared for in the infant classroom at the same time.

During interviews, Staff #1 stated on 8/16/22 that there were “6 infants and a handful of preschool students” in the infant room. The CSR for the preschool program for 8/16/22 shows 5 preschool children were signed in, with one staff present between the time of 6:30 am to 7:39 am. The one staff present on the preschool CSR was also the only staff present on the infant CSR showing 6 infants were signed in from 6:30 am to 7:49 am.

Additional staff interviews stated the following: Staff #2 stated they had observed an infant being taken to the preschool room for care at the end of the day on more than one occasion. Staff #4 stated she had observed infants being cared for in the same room as preschool children. Staff #4 additionally stated, “I know one time, one of the toddlers had slept in there”. Staff #5 stated, “I was leaving for lunch and I saw one of the infants in the preschool room”.

The Senior Director stated, “I know one morning they did because a staff member called out and they had to stay together until another staff member came in”. The Group Me Infant Chat shows a text on 8/16/22 at 6:43 am, that states “2:1 infant + 2 preschoolers in infant”.

Based on the information gathered, and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22 Chapter 1 are being cited on the attached 9099D. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

LPA Lilli Babcock informed facility representative, Jamlia Rivers, that this report dated 11/3/22 documents 1 Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Lilli Babcock informed the facility representative to provide a copy of this licensing report dated 11/3/22 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The Director states that she will ensure the infant classroom always maintains the required staff/child ratio by scheduling a staff member to come in early to step in for infants when needed. Typically, the problem with ratio was in the morning, so this should correct the problem.

Director will ensure infant and preschool children are not commingled at any time by providing additional staff to make sure staffing is sufficient. Director will also provide training during staff meeting on 11/11/22 on not commingling. Director will email LPA the agenda and sign in sheets for metting.

Based on interviews and records review, the facility operated beyond the conditions of the license (serving infants aged 0-2 only) when they commingled infants and preschool children in 1 out of 1 infant classrooms. This poses a potential health and safety risk to children in care.
