32 | Allegation #1: Facility is out of ratio.
According to the allegation, the infant program has been out of ratio during the month of August. Interviews conducted and documents reviewed by LPA revealed the following:
Staff #1 stated they observed the infant program to be out of ratio on August 16, 2022, for approximately 20 minutes. In addition, the Child Supervision Record (CSR) obtained by LPA for August 16, 2022 shows there were 6 infants signed into the infant room for the time period of 6:33 am – 7:40 am and only one staff was present from 6:30 am to 7:49 am, which indicates they were out of ratio.
Lastly, during interviews conducted, Staff #2 stated the infant program was out of ratio “4-5 times” during the month of August. Staff #1, Staff #2, Staff #3, Staff #4, and Staff #5 stated staff either “walkie” or “send a group text on the Group Me app” to signal their capacity and to notify staff if they are going to be over ratio. The Department received screenshots of the text stream on the Group Me app for the infant program, which showed the following:
8/1/22 at 8:29 am, the ratio was “6:1”
8/2/22 at 8:44 am, the ratio was “5:1”
8/15/22 at 7:43 am, the ratio was “5:1”
8/16/22 at 7:41 am, the ratio was “6:1”
8/22/22 at 8:11 am, the ratio was “5:1”
8/24/22 at 7:57 am, the infant room had a ratio of “1:6”
9/7/22 at 7:53 am, the infant room had a ratio of “5:1”
Allegation #2: Facility commingled day care children.
The complaint alleges infants and preschool children were cared for in the infant classroom at the same time.
