32 | Based on statements disclosed during interviews with Director, S2 and S3 there were conflicting statements that C2 was being shadowed, another statement was that C2 did not need to be shadowed. Other statements were made that S2 was occupied changing a diaper while S3 was with 2 other children. Both S2 and S3 observed when C2 had the arms around C1 on the table. There were no clear communication or special arrangements to prevent from C1 being injured.
This agency has investigated the complaint alleging that “Daycare child sustained unexplained injuries while in care”.
Based upon the evidence as listed above, the preponderance of evidence standard has been met and the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 101223 "Personal Rights" is being cited on the attached LIC 9099D.
LIC 9224 ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS was provided.
A Notice of Site Visit was provided to director.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Director Crystal Cyprian this report along with Appeal Rights (LIC 9058) were provided to Director.
