An unannounced inspection was conducted by Licensing Program Analyst (LPAs) Roxana Lopez and Mary Silva on 7/14/2023. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 05/19/2023. LPA met with Director Jenny to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, children, and parents. LPA also reviewed and obtained copies of children’s rosters, personnel reports, incident reports, and other documentation.

Per the initial complaint report, the complainant reported that they have witnessed staff being aggressive to children, their child sustained injuries at daycare that were not reported, and that the facility discriminated against their child. LPA was unable to interview the complainant or Child # 1 to gather additional information. ----------------------------------------------------------pg.1 of 2--------------------------------------------------------------------------

Regarding allegation # 1 Staff are aggressive with children in care, allegation # 2 Staff did not follow proper reporting requirements, allegation # 3 Day care child sustained injuries while in care, and allegation # 4 Facility discriminated against the day care child. LPA conducted interviews with staff # 1- 3. All staff statements corroborated that they have not been aggressive to children in care and have not witnessed any staff being aggressive to children. Staff # 1-3 corroborated that if children are having a hard time they talk to the child, go down to the children’s level to talk about the situation, and work out a plan. Staff 1-3 also corroborated they offer different areas for children to calm down if needed. Additionally, Staff corroborated that they inform parents of any incidents that they witnessed. Staff # 3 disclosed that they provide parents with an incident report and depending on the injury they call parents ahead of time to inform them. Staff 1-3 corroborated that they have not discriminated against day care children.

LPA conducted interviews with parents and children. Parent statements corroborate that they do not have any concerns with teachers, they are happy with the care children receive and they have been informed if their child gets injured while in care. Children’s statements corroborate that they like their teachers.

This agency has investigated the complaint alleging: the staff is aggressive with children in care, the staff did not follow proper reporting requirements, the day care child sustained injuries while in care, and the facility discriminated against the day care child Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with the Director Jenny.
