Licensing Program Analysts (LPAs) Cynthia Reyes and Staicy Perry conducted a case management inspection due to an incident that occurred on 09/30/23. LPAs met with Administrator Elvia Rodriguez. LPAs observed that there were 14 infant/toddlers present during the time of inspection. Elvia guided the analyst on a tour of the facility inside and out.

There was one (1) Incident report that came into the office on 10/02/23 with 3 incidents listed. The first incident is regarding a staff member who reported during diaper changes she would hear slapping on the skin and would hear the babies would start crying. She is alleging that this would happen by 4 Co-staff members. The next incident was regarding a child who was left unattended on 09/14/2023 in the outdoor play yard. The last incident is regarding staff members was giving a child the wrong bottle.

The incident regarding staff members being heard slapping a child during diaper change was alleged by a former staff member who stated per interviews that she only heard but did not see anything happen. Per interviews with several staff, there was no disclosures of any staff being heard or seen slapping or hurting any child in the infant/toddler class rooms. Infants/toddlers are non-verbal and were unable to interview.
Per the facility own investigation as well as the departments, there were no disclosures or evidence of this incident occurring. No citation is being given for this incident.

The Incident regarding a child who was left unattended on 09/14/2023 in the outdoor play yard, per interviews it was stated that the child was left outside on the play yard for about 1-5 minutes alone. Disclosures were made verifying that the incident did occur. Title 22 Regulation Section 10101229(a)(1) states, Responsibility for Providing Care and Supervision, no child(ren) shall be left without the supervision of a teacher at any time, supervision shall include visual observation. This was an immediate risk to the health and safety of the child in care. See 809D for citation.

The incident regarding staff members giving a child the wrong bottle. Per interviews it was stated that staff #2 gave a child the wrong bottle a couple weeks ago and back in February of this year staff #1, per a mis-communication had given a child the wrong bottle. Per interviews with several other staff, there was only one disclosures of a staff giving the wrong bottle. Staff #1 disclosed that she had given the wrong bottle back in March when she first started and disclosed that staff #2 had told her about the incident of herself giving the wrong bottle a couple weeks ago. One staff member heard a couple of the staff talking, which included staff #2 stating a child was given the wrong bottle. Citation is being given.

LPAs conducted interviews with staff, made observations by touring the facility and obtained documentation during this inspection. The facility has conducted there own investigation and no disclosures were made to them regarding children being no disclosures of any staff being heard or seen slapping or hurting any child in the infant/toddler class rooms. However it was disclosed to the facility and the department that yes a child was left on the play ground alone and yes a child was giving the wrong bottle. This was an immediate risk to the health and safety of the child in care. See 809D for citation.

The facility self reported these incidents and followed all proper procedures per the parent hand book/admission agreement, incident reports were called in and sent in properly and timely and parents notified. However due to two of the incidents occurring citations are being given on this date.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

The deficiency listed on the following page is being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809D. Deficiency that is being cited needs to be cleared to protect the children’s health & safety.

Upon receipt of this report, the licensee shall post any licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies of this report to the parents of children enrolled and to any parents of newly enrolled children in care for up to one year. Parents are required to sign the LIC 9224 Acknowledgement of Receipt of Licensing Reports, and a copy must be placed in children's files. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

Director states all staff will be retrainined on transitioing children from indoor/outdoor. New procedures will be implemented to make sure no child is left behind. Director will submit to the department a list of teachers signatures and training agendas covered during retraining by the POC date of 10.10.23
