On 8/11/26, at 9:45AM, Licensing Program Analyst (LPA) Joe Katrdzhyan conducted an unannounced follow up complaint visit to this facility. Upon arrival at the facility, the LPA met with the Licensee, Rita Noninyan, who provided a tour of the facility. During the visit, 13 children and 4 staff members, including the Licensee, were observed present. The LPA explained that the purpose of the visit was to obtain additional information regarding the above-mentioned allegation and to potentially resolve the complaint.

During the course of the investigation, LPA conducted interviews and obtained copies of the children’s roster and other supporting documentation.

Per the Reporting Party, Adult in home handled day care child in a rough manner resulting in injuries.

During the interview with the Licensee, the Licensee denied that Adult 1 handled Child 1 in a rough manner resulting in injuries. Per the Licensee, she was away and out of town on the date of the alleged incident,

June 12, 2026. Upon returning on June 14, 2026, the Licensee was informed by Adult 1 and Staff of the incident involving Child 1. The Licensee stated that Child 1 was fighting with Child 2, his sister. Staff 1, the Licensee’s mother, and other staff members were unable to separate Child 1 from Child 2. Child 1 would not follow instructions. Staff 1 therefore called Adult 1 and asked him to come to the facility to assist. Adult 1 arrived, observed Child 1’s behavior, and attempted to speak with him. However, Child 1 did not listen and continued fighting with his sister. Adult 1 then removed Child 1 from his sister by grabbing his arm and placing him on the living room couch. Per the Licensee, none of the staff members reported observing Adult 1 handle Child 1 in a rough manner or cause injuries. Staff present at the time of the incident stated that Child 1 was out of control and would not follow instructions. After Child 1 was separated from his sister, staff did not observe any injuries to Child 1, and Child 1 did not report any injuries or discomfort to staff, including a cut to his arm or a bruise to his leg. Per the Licensee, Child 1 has a history of behavioral incidents involving fighting with other children, particularly his sister, as well as throwing the remote control when upset. The Licensee stated that June 12, 2026, was the last day Child 1 attended the day care. On Sunday, June 14, 2026, the Licensee sent a text message to Child 1’s Parent asking whether Child 1 would be returning to the day care on Monday, June 15, 2026. The Parent informed the Licensee that Child 1 and his siblings were moving to another city to stay with their other Parent and would not be returning to the day care. The Licensee stated that, during the conversation with the Parent, the Parent did not express any concerns regarding Adult 1 handling Child 1 in a rough manner or causing injuries. The Parent did not mention observing a cut on Child 1’s arm or a bruise on Child 1’s leg. Law Enforcement was not involved, and the Licensee stated that she first learned of the complaint and the allegation from LPA. The facility has surveillance cameras however, the Licensee was unable to produce surveillance footage from June 12, 2026, because no video was available. The Licensee stated that when a child exhibits challenging behavior and does not follow instructions, the child is typically removed from the situation and asked to sit on a chair to think about what they did wrong. Staff then speak with the child and explain the inappropriate behavior. After a few minutes, the child is released and asked to rejoin the other children. During the investigation, LPA confirmed that Adult 1 has a criminal record clearance and resides at the day care facility.

During the interview with Adult 1, Adult 1 denied handling Child 1 in a rough manner resulting in injuries. Adult 1 stated that he was not at the facility when the incident began involving Child 1 fighting with Child 2, who is his sister. When staff were unable to separate Child 1 from Child 2, Staff 1 called Adult 1 and asked him to come to the facility to speak with Child 1 and assist with the situation. Adult 1 stated that staff informed him that Child 1 was cursing and fighting with Child 2. Child 1 was also viewing inappropriate

videos on his cell phone, which resulted in staff taking the phone away from him. When Adult 1 arrived, Child 1 told him that if he did not get his phone back, he would "behave really bad." Adult 1 told Child 1 that his phone would be given to his Parent at pick-up time because he had been viewing inappropriate videos on the phone. Child 1 continued fighting with Child 2. Adult 1 then grabbed Child 1’s arm and walked him to the living room couch, separating him from Child 2. Adult 1 stated that Child 1 resisted and yelled for him to let go of his arm, stating that he could do whatever he wanted. Adult 1 stated that Child 1 continued exhibiting behavioral issues after being separated. Staff subsequently decided to return Child 1’s phone to determine whether he would calm down. Per Adult 1, Child 1 had exhibited behavioral issues in the past however, his behavior on June 12, 2026, was more severe than usual. Adult 1 believed that Child 1 may have been aware that he was going to be moving away, which may have contributed to his behavior. At pick-up time, Child 1’s Parent arrived and was informed of Child 1’s behavior. Child 1’s siblings went outside to meet their Parent however, Child 1 initially refused to leave the facility and remained inside for approximately 10 minutes before leaving.

During interviews with staff, staff members also denied the allegation and stated that they did not observe Adult 1 handle Child 1 in a rough manner resulting in injuries. Per staff, Child 1 did not complain of any injuries or pain resulting from Adult 1’s intervention. The statements obtained from staff were consistent with the statements provided by the Licensee and Adult 1.

During interviews with children enrolled in the program, the children expressed positive experiences regarding the day care program. The children stated that they enjoyed attending the program and did not report any concerns related to the allegation identified in the complaint.

The parents interviewed also did not express any concerns related to the allegation identified in the complaint. Instead, the parents reported being pleased with the services and care provided to their children.

During the course of the investigation, LPA made multiple attempts to contact Law Enforcement to determine whether an investigation had been conducted regarding the allegation identified in the complaint. However, LPA was unsuccessful in making contact with Law Enforcement.

Based on the investigation conducted, there is insufficient evidence to support the above mentioned allegation to be true. Therefore, although the allegation may have happened or is valid, there is not a

preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Exit interview was conducted with Rita Noninyan, Licensee including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role.
