At 9:45 am Licensing Program Analysts (LPAs) Lilli Babcock and Priscilla Ochoa conducted an unannounced annual inspection to the above facility. A COVID risk assessment was conducted. LPAs met with Licensee, Olivia Marquez, to whom the reason for the visit was explained. Per Licensee, there are 6 children currently enrolled. There were five children present upon arrival. The licensee was observed to be operating within the license capacity limitations.

The licensee states that five adults and three children currently live in the home. Per Licensee, there is one assistant in the facility. All adults living in the home have obtained a criminal record clearance.

Facility is a single-story home, containing 3 bedrooms, 2 bathrooms, den, kitchen, living room, dining room, garage, east side yard, and backyard with in-ground swimming pool. Side yard on west side of home contains a built-in storage shed and is locked with a key lock. Backyard is fenced and side yards are enclosed with metal gates and fencing.

Per Licensee, off-limit areas to the children and parents will be 3 bedrooms, 1 bathroom, kitchen, living room, dining room, garage, west side yard with shed, and backyard with in-ground swimming pool.

Per Licensee, areas accessible to children and parents will be den, bathroom located in hallway, and east side yard for outdoor play.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation, the licensee did not comply with the section cited above in 1 out of 2 gates which are not 5 feet tall and do not self-latch and self-close which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee guided analysts on a tour of the facility. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed.

Facility License, Emergency Disaster Plan, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. A current children’s roster was available for review.

There is telephone service via a cellphone and landline. Hours of operation are Monday – Friday, 6:30 am – 6:00 pm. There is central air and heating in the home. LPAs observed a fireplace located in the den. The fireplace has a glass screen and contains a chain with padlock, making it inaccessible to children.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per Licensee, poisons are locked in the off-limits shed with a key lock. LPAs observed the shed to be locked during the inspection. LPAs advised that any poisons should be locked under key or combination lock. Licensee states that there are no firearms or weapons stored in the home, and none were observed on this day.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 6/26/24, as indicated on the service tag. Smoke and carbon monoxide detectors were tested and were operable on this day.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 5/15/24.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children. Appropriate sleeping arrangements in form of playpens and mats were observed.

Licensee states she is currently caring for two infants. LPAs observed a sleep log for the infants.

The children will use the east side yard for outdoor play, which is fenced and contains a metal gate on each end. Age-appropriate toys were observed. The outdoor play area was observed to be fenced. LPAs observed a built-in swimming pool in the backyard of the home. The swimming pool has a gate on each end of the pool. The gate on the east side of the pool was observed to swing away from the pool, self-close and self-latch. At 10:50 am, LPAs observed the gate on the west side of the pool was 4 feet 11 inches tall and the gate did swing away from the pool but was not observed to be self-closing and self-latching. On this day, LPAs observed a working alarm on the sliding door of the master bedroom that leads directly to the pool.

Children’s records were reviewed, including emergency information, and were observed to be complete.

Licensee records were reviewed. LPAs observed that the Licensee does have proof of pertussis, measles immunizations, and a Mandated Reporter AB 1207 compliant Child Care Training Certificate on file with expiration on 8/3/25.

The licensee has completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR with the American Heart Association expires on 3/15/26.

LPA issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

Per licensee there are no pets in the home and none were observed by LPAs on this day. Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee Olivia Marquez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Based on LPA's observations and record reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children's health and safety.



A notice of site visit was given and must remain posted for 30 days.
