32 | Per S1, S8 and S9 were in the classroom with 6 infants who were awake and 1 napping infant, a total of 7 infants. S9 had left for the day without informing anyone and left S8 alone with 7 infants. Per S9, they left at their usual time, however S8 was out of ratio. Per S1, S8 and S9 are no longer working with the facility. LPA reviewed the statements S8 and S9 had written describing the incident. S2 and S5 mentioned that the facility has been out of ratio due to low staff and call outs. They both described when staff need to use the restroom, they either do not have coverage or they are asked to wait until admin finds coverage. Per S2 there have been instances where they have called for coverage and no one is able to cover, so they are forced to go to the bathroom quickly and come back to the classroom. S5 also mentioned that due to call outs they have also been out of ratio. More children than expected attend the facility, but the facility does not always have enough teachers. S9 also mentioned that some classrooms are connected by a door. S9 disclosed that in some cases teachers from the other classroom will stand in the middle of the doorway to assist while a teacher needs to step out. LPA did not interview any children, as this is an infant program and children are nonverbal. LPA interviewed Parent 1(P1) – Parent 3 (P3). All parents did not express any concerns about the care and supervision the staff provide at the facility. P1 – P3 are happy with the facility.
Based on interviews conducted and record review, the above allegation is deemed SUBSTANTIATED. A finding of Substantiated means that the preponderance of evidence standard has been met. The following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
A notice of site visit was given and must remain posted for 30 days during facility’s hours of operation. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
An exit interview was conducted, and a copy of the report was provided to the Director, Rebecca Kelly.
