32 | chewing food, licensee yells at child#9. Per Child#2, licensee and her husband sometimes yell at children. Per child#4, if child#4 talks or laugh loud, licensee yells.
Based on an interview that was conducted with licensee, she raised her voice to children to grab children's attention but did not mean to yell at children.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegation is found to be Substantiated at this time. California Code of Regulations, 102423(a)(2))—Personal Rights--(2)--To receive safe, healthful, and comfortable accommodations, furnishings, and equipment is being cited on the attached LIC9099D.
LPA Anomeh Eivazian informed Licensee, Ofelya Sargsyan that this report dated 08/01/2023 document(s) 1 of Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Anomeh Eivazian informed the Licensee, Ofelya Sargsyan to provide a copy of this licensing report dated 08/01/2023 that documents 1 Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
