32 | from the group and has the child sit on a chair for approximately five minutes. During this time, the Licensee speaks with the child, explains the inappropriate behavior, and discusses what the child should do differently in the future. The Licensee reported that multiple verbal warnings are provided prior to separating the child. The Licensee stated that parents are notified if the behavior is of serious concern. The Licensee denied ever requiring children to stand outside in hot or cold weather when upset or excluding children from participating in activities or events, such as parties, due to misbehavior. The Licensee stated that she has operated a day care for over ten years and is aware of appropriate discipline practices. The Licensee denied yelling at children, stating that while her tone of voice may be loud, it is never used with ill intent toward the children. The Licensee reaffirmed that neither she nor her staff use inappropriate discipline practices or yell at children.
During the interview with the staff, they also denied the allegations and did not report observing any of the alleged incidents mentioned. Their statements were consistent with the Licensee's responses.
During interviews with children, they expressed positive experiences regarding the day care program. The children stated that they enjoy attending the program and did not report any concerns related to the allegations listed in this complaint.
The parents interviewed also did not express any concerns related to the allegations mentioned in this complaint. Instead, they were pleased with the services and care being provided to their children.
Based on the investigation conducted, there is insufficient evidence to support the above-mentioned allegations to be true. Therefore, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
