On April 16, 2025, at 11:30am, Licensing Program Analyst (LPA) Monica Ruiz conducted an unannounced annual random inspection. A risk assessment was conducted prior to entering the facility. LPA met with licensee, Maria de Los Angeles Trujillo who guided analyst on a tour of the facility both indoors and outdoors. There were five (5) children present upon LPA's arrival. The licensee's child was also present. Licensee states that there are currently nine (9) children enrolled.

This is a one-story home which consists of front yard (fenced), 3 bedrooms, 1 bathroom, living room, dining area, kitchen and laundry room.

Areas that are accessible to children in care are the living room/dining room (main day care area), restroom (located in bedroom #2), bedroom #2. Based on the Facility Sketch submitted, areas off-limits to children and parents will be two (2) bedrooms, kitchen, laundry room, front yard (fenced). The LPA toured all areas used by children during this visit.

Areas accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for safety and comfort. Child care takes place in the living room. There were safe toys, play equipment and materials observed for children to play with such as a dramatic play area, art supplies, play trucks, sensory toys, and puppets. Licensee has labelled cubbies for children to store personal napping equipment. LPA observed appropriate napping equipment in the form of mats available for children in care. There is a working cell phone maintained in the home along with a Ring camera system at the front door.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

There are child proof door knobs on the doors to the off-limit areas. LPA observed a wall heater in the living room that is completely covered with a vented metal cover to make it inaccessible to children in care. LPA observed two (2) high chairs and a long children’s table in the dining area for children in care to use while eating. Licensee states she provides breakfast, lunch, dinner and snacks for children. LPA observed there to be adequate food and beverage for children in care. There is a baby gate in place that prevents children from entering the off-limits kitchen from the dining area.

LPA observed and inspected sleeping equipment for infants. Licensee states she has one (1) infant enrolled in her day care. Sleep log for infant in care was reviewed and is complete. LPA observed one (1) play yard available in bedroom #2 that is used for napping. There is also a changing table in bedroom #2. All equipment meets the US Consumer Product Safety Commission safety standards. LPA observed the play yard is free from loose articles and objects. There are no objects hanging above or attached to the side of the crib. LPA observed that the play yard does not hinder the entrance or exit to and from the space they are sleeping in. Per Licensee, each infant will have their individual bedding and bedding will be washed weekly as required. Licensee states, soiled bedding will be replaced when wet or soiled and will be placed in an area inaccessible to infants. Licensee was advised that infants shall not be swaddled while in care and all infants up to 12 months should be placed on their back for sleeping.

Per licensee, there is one cat (kept in the off-limits bedroom #2) and no weapons or firearms on the premises. Licensee maintains vaccination records for the cat. Children’s records were reviewed to ensure that each child has an Identification and Emergency form. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was last serviced on 9/2024. Smoke detector and carbon monoxide detector located in the dining area were not tested due to children napping.

LPA observed front yard to have adequate shade and fencing along the perimeter. Licensee states that front yard will be re-paved at the end of the month so that she can take the children in care outside to play. LPA observed a painting table and sand garden for children to use while playing outside. LPA observed outside play area to be safe for children in care to use. LPA reminded licensee to supervise children while playing outside.

The licensee has current Pediatric First Aid and CPR, which will expire 12/2025.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. SB792 (Immunization Requirements for Staff and Employees) was discussed with the Licensee. The Licensee does have immunization documentation on file.

AB1207 Mandated Child Abuse Reporting – On or before March 30, 2018 any person who works in a child care facility shall complete the training and renew the training every 2 years. The following was discussed:

· Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain a criminal record background check clearance prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty.


· The Licensee shall be present in the home and shall ensure that children are supervised at all times.
· Children shall not be left in park vehicles.
· The capacity specified on the license shall be the maximum number of children for whom care can be provided.
· Car seats shall only be used for transportation purposes and shall not be used for sleeping.
· All children in care have the right to receive safe, healthful, and comfortable accommodations, furnishings and equipment.
· When a child shows signs off illness, they will be separated from other children until the nature if the illness is determined.

LPA advised the licensee how to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov

At this time, the licensee is in compliance with California Code of Regulations Title 22. At this time, the licensee home meets the description of a safe and healthy environment for children as described in Chapter 1, Division 12, Title 22 of the California Code of Regulations.

A notice of site visit was given and must remain posted for 30 days.
