32 | the hallway of bedrooms, child#2 who was on the chair in the living room, started to run towards the bedrooms hallway, where the floor is tile. Per staff#3, staff#3 stated in a louder tone, like yelling:” Stop child#2, Go Sit, No child#2”. Per staff#3, raised voice to grab child#2’s attention to stop running on tile area. Per staff#3, at that time the living room window was open and child#1’s mother heard staff#3 voice.
Based on LPA’s observations, living room which is daycare area, the floor is covered with cushion mats, and the area in front of the kitchen and bedrooms hallway is tile. LPA watched and heard Ring camera video footage for 06/17/24, at 12:11PM LPA heard a male stated in a loud voice, “Stop child#2, Go Sit, No child#2”.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegation is found to be Substantiated at this time. Title 22 Regulation code102423(a)(1)--Personal Rights—(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (1)To be treated with dignity in his/her personal relationship with staff and other persons is being cited on the attached LIC9099D.
LPA Eivazian informed licensee, Arpik Hakobyan that this report dated 08/05/24 document(s) 1 Type A citation Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Eivazian informed the licensee, Arpik Hakobyan to provide a copy of this licensing report dated 08/05/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
