Licensing Program Analyst (LPA) Anomeh Eivazian conducted an unannounced complaint inspection to the above facility on 05/01/23 regarding above allegations. LPA arrived at 9:40 a.m. and met with Lauren Friedman, director who guided analyst on a tour of the facility. During this inspection there were 10 infants present in the facility with 6 staff.

During this investigation, LPA Eivazian conducted interviews with 5 staff.

Based on interivews that were conducted with staff#3 and staff#4, teachers use bouncers in infant Hive classroom (0-12 months old classroom). Per staff#3 and staff#4 there were occasions that infants fell asleep on the bouncers and stayed on bouncer about 10-20 minutes and then a teacher moved the napping infant to the crib area.

Based on staff #1 interview, they have had bouncers in the Hive infant classroom (0-12 months old) because they did not know it is not allowed. Per staff#1, infants did not sleep on the bouncers.

Based on LPA Eivazian observation on 05/01/23, LPA observed two bouncers in Hive infant classroom (0-12 months old). LPA observed one infant was on the bouncer and playing. LPA also observe a bouncer on the outdoor playarea.

Based on LPA observations and interviews which were conducted, the preponderance of evidence standard has been meet, therefore the above allegations are found to be Substantiated at this time. California Code of Regulations--101439(d)(2), Infant Care Center Fixture, Furniture, Equipment and Supplies: A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Section 1596.846. This also includes baby bouncers. and 101223 (a) (2)--Personal Rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs, are being cited on the attached LIC9099D.

LPA Anomeh Eivazian informed director, Lauren Friedman that this report dated 05/01/2023 document(s) 2 of Type A citations. Type A citations which shall be posted for 30 consecutive days as there are immediate risk(s) to the health, safety, or personal rights of children in care.



Also, LPA Anomeh Eivazian informed the director, Lauren Friedman to provide a copy of this licensing report dated 05/01/2023 that documents 2 Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Per director, she will not use bouncers in the facility anymore. Per director infants will sleep on the crib or cots based on their age.

Based on staff#3 and staff#4, there were times that while infants were playing on the bouncers fall asleep and slept on the bouncer about 10-20 minutes and then a staff moved the infant from bouncer to the crib. This poses an immediate health, safety, and personal right to the children in care.

Per director, she did not know bouncers are not allowed. However during this inspection director took out all three bouncers from the facility.

During this investigation, LPA Eivazian conducted interviews with 5 staff.

Per staff#2, staff#3 and staff #4, while infants are napping in crib room, either with crib room door open or closed, crib room monitor is on for supervision. Per staff #2, staff#3 and staff#4, a staff member do a walk through on the napping infants in the crib room at least every 15 to 20 minutes.

LPA observed that crib room is connected to Hive Infant classroom (0-12 months old), which is separated by full clear glass walls and a clear glass door to the ceiling. (Pictures were taken).

Although the allegation may have happened or is valid, there are not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the above allegation is Unsubstantiated.

The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
