32 | LPA conducted interviews with parent 1 (P1 thru 6), who made no disclosures. Per P6, they do not have any issues or concerns. LPA obtained and reviewed copies of the staff and children’s sign in and out sheets for the month of April. LPA observed that the licensee and S2 were out of ratio on 04/02, they had 15 children in care and 14 children in care on 04/03. Based on observation, the licensee and S2 are both toddler teachers; however, they do not meet the qualifications.
Allegation regarding- Staff are not abiding to the admission agreement. According to the complainant, they did not receive a copy of the financial agreement and is seeking a partial refund. Per RP, they received copies of all the forms they completed; however, the financial agreement is missing. LPA conducted interviews with S1 and S6, who made no disclosures. According to S1, they deny that the facility has violated their admission agreement. Per S6, the facility has not violated the admission agreement and stated that the facility does not refund parents if they decide to disenroll their children. S6 also stated that parents receive the financial contract and are made aware of their non-refundable policy during the facility tour. LPA conducted interviews with P1 thru 6, who made disclosures. According to P5, they received copies of the admission agreement; however, they did not have a copy of the financial contract. LPA conducted file reviews for child 1 (C1) and observed that C1 did not have a copy of the financial contract.
Based on record review and interviews, the preponderance of evidence standard has been met, therefore the above allegations is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).
LPA Veronica Martinez Garza informed director Annel Dominguez that this report dated 07/08/24 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Veronica Martinez Garza informed the director Annel Dominguez to provide a copy of this licensing report dated 07/08/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
