On 2/22/2023 at 2:00 PM Licensing Program Analyst (LPAs) Staicy Perry and Nolan Tcheng conducted an unannounced Case Management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. A COVID 19 risk assessment was conducted prior to entering the facility. LPAs met with facility Director Aremi Sanchez during the visit. Also present in the facility 26 children, 7 staff members. Facility was within ratio & capacity.

Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility Director during the inspection. Per AB 2370, all CCCs that are in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.

On 9.13.2023, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 7.8.2023. Drinking fountain reported with 5.6 ppb or greater lead exceedance level were as follows:
  • During this inspection, water outlet “C” , was observed that the drinking faucet has been removed permanently and is not planning to utilize that as a drinking fountain. Photos have been provided via email to LPA from previous visit as well as new photos on todays inspection.

Director stated that the facility has not been using the drinking faucet to conduct the lead testing. Facility was licensed on 03/27/2023. Per Director, LPA Green, who conducted the pre licensing with facility, informed them to cover all drinking outlets until they have the outlets tested for lead exceedance. Outlets were made inaccessible to children in care since the opening of the facility. Following the lead testing, children use the kitchen water dispenser which passed the lead test. Kitchen faucet has a filter. Per Director children bring their own bottles labeled with their names and get filled up as needed.

LPAs Staicy and Nolan received all documentation, including facility sketch, LIC9276, LIC9275, photos and test results from Aremi Sanchez, Director during previous visit on 11/01/2023.

A deficiency was cited on attached 809D. The deficiency listed on the following page were observed by the LPAs and is being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809-D. The deficiency that is being cited needs to be cleared to protect the children’s health & safety.

A notice of site visit was given to licensee and must remain posted for 30 days.

Exit interview conducted and report was reviewed with the Director Aremi Sanchez.
