32 | The Licensee stated that the Director did resign on 12/07/2023, but there have been no children enrolled in the school age license since the end of October 2023. The Licensee stated the Director did not want to show up to the facility and chose to work from home due to various reasons. The Licensee stated that the Director was paid an hourly rate, so the fact that the Director did not work a full 8 hours during a work day did have an effect on their pay.
During the course of the investigation, LPA Lee observed that there are no children in enrolled in the school age program. There is an overlap of older children being at the premise despite not being enrolled in the school age program since this facility is located within a YMCA building. The alleged incident involving the ladder on 11/09/2023 occurred when no children were enrolled in the school age program. It was not clear if the former Director was giving a tour for a potential client in the school age or preschool program. The Licensee is aware that a qualified Director must be present at the physical location of the facility before any children are enrolled in the school age program. Since there are currently no children being provided care by the facility, the fact that the facility does not have a qualified Director at the moment is not a violation of child care center regulations.
Based on the evidence collected during the investigation, the allegations that unqualified staff is acting as site supervisor, staff did not prevent hazardous item from blocking walkway, facility is financial despair may be valid. However, there is not enough preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegations are found to be unsubstantiated.
The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting during business hours will result in a civil penalty $100.00 dollars
