children. Complaintant is also upset because now complaints child is repeating profanity words. During interviews conducted, there were no disclosures by staff, or parents regarding profanity language being used at the facility due to staff watching the game nor any profanity being used. All staff stated that phones or televisions are not allowed inside the classrooms and that the facility does not have televisions in the classrooms. LPA did not observe any televisions and or staff on their phones during inspections, nor did LPA Perry hear children or staff using profanity language. LPA did observe a policy regarding cell phone usage posted next to clock in machine reminding all staff of their policy on phones and storage for staff to place their personal belongings including their phones away. Parents interviewed reported they were happy with the care and supervision provided by the facility.

Allegation 2: Child sustained an injury

The complaint alleges that on 10/22/24, an ouch report that was provided indicated that child was running, tripped, and scrapped their leg. Per complainant staff did not provide any details as to how the incident happened; however, complainant believes that staff were not supervising children because they were watching the baseball game. Also, complainant indicated that this is not the first-time injuries have been sustained. During interviews, staff stated ouch reports are provided to parents when an incident occurs with a child and that staff talk to parents about what happened. Staff also stated ratios and supervision are always maintained and that televisions or cell phones are not allowed inside the classrooms. Parents interviewed stated they have never witnessed teachers to be on their phones or watching televisions or using profanity language. Parents interviewed reported they were happy with the care and supervision provided by the facility and had no concerns with staff. LPA Perry did not observe any television. LPA did observe a policy regarding cell phone usage posted next to clock in machine reminding all staff of their policy on phones. LPA did observe all ouch reports, and none indicated a child was running, tripped and scrapped their leg on that day nor days prior or days after.

This agency has investigated the complaint alleging Staff are using profanity words in front of children and child sustained an injury. Based upon the evidence as presented above, the allegations have been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove alleged violations did or did not occur, therefore at this time the above allegations are unsubstantiated.
