On 11/21/24, at 2:15 pm , Licensing Program Analyst (LPA ) Shushanik Safaryan conducted an unannounced visit to deliver findings regarding complaint investigation received by the Department. During the visit , LPA met with Facility Representative , Emily Laguna , to whom the purpose of the visit was explained. Facility Representative guided LPA on the tour of the facility. This is the preschool program with toddler option that consists of 3 classrooms .During the inspection LPA observed 22 children with 4 staff members.
Complaint alleged : Staff are not ensuring outdoor space is free of tripping hazards causing children to sustain injuries.

During the investigation process , LPA toured the outdoor space and observed uneven pavement area next to the benches and sand pit .(Pictures were taken ). LPA interviewed 5 staff members and the Director . Staff members disclosed , tripping and falling incidents more often happening in the area where uneven pavement and sand pit. Per staff members , in the area where uneven pavement ,incidents can occur from one to three incidents per week .

Based on the incident reports and staff members, extend of injuries scrapped knee and elbow. Per staff , incidents occurred when children run , drive bike or car and forget about lump in that area . During the children file review, LPA observed multiple incident (ouch) reports for different children . LPA verified with staff , who created the ouch report the area of the incidents . LPA contacted parent regarding incident reported by the complainant . Per parent , C3 and C4 had a recent incident outside in outdoor play area . Director stated ,ouch reports completed by the staff members who observed the incidents . Per Director , often incidents in outdoor are due to the sand on the pavement which causes children slip and fall .

Based on LPA`s observations and interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division & Chapter one ), are being cited on the attached LIC 9099D.

Exit interview conducted with Facility Representative ,Emily Laguna . The Notice of site visit , report and Appeal Rights were explained and provided to Facility Representative on 11/21/24 date.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.

LIcensee stated she will block off the area , gardener will clean every week to put the sand back in the sand area .License stated teachers will clean sand pit area to make sure no sand on the pavement .Licensee will send the pictures of correction to the LPA by POC date .

Multiple incdents were recorded in the area where uneven pavement and sand pit . LPA observed incident reports in the children`s files and verified with staff place of the incident. Per staff uneven pavement is the area where most of the incidents happened. Disclosures were made that it could be at least 1-3 incidents per week .
