32 | Based on an interview that was conducted with staff#1, on 08/20/24, while staff#1 was on the lunch table with children, staff#1 asked child#3 "are you done with your food", at that time staff#1 pushed the food plate from one side of the table to the other side of the table where staff#2 was, and food fell down on the floor. Per staff#1, she wanted to give the food plate to staff#2 and pushed the plate on the table towards staff#2. Per staff#1, after she pushed the plate toward staff#2, food fell down on the floor, the food was rice and couple rice might dropped on child#1 and child#3's head.
Based on an interview that was conducted with staff#2, staff#1 and staff#2 were on the lunch table with children, staff#3 was in the kitchen, staff#1 pushed child#1's food plate from her side of the table towards staff#2 and it fell down on the floor, but not on the kids head.
Based on interviews that were conducted with Child#1 and Child#4, child#1 did not eat food and staff#1 dropped the food on child#1's head.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegation is found to be Substantiated at this time. Title 22 Regulations code 102423(a)(1)-- Personal Rights--(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (1) To be treated with dignity in his/her personal relationship with staff and other persons is being cited on the attached LIC9099D.
LPA Anomeh Eivazian informed licensee, Silvana Zadoorian that this report dated 10/01/24 documents 1 Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Eivazian informed the licensee to provide a copy of this licensing report dated 10/01/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
