Licensing Program Analysts (LPAs) Nolan Tcheng and Saul Valenzuela conducted an unannounced subsequent inspection of a complaint investigation for the purpose of delivering complaint findings. The complaint investigation was investigated by Community Care Licensing Investigation Branch (IB) investigator Veronica Padilla. Upon arrival at 8:30am, LPAs were met by Director Christine Jennings, to whom the purpose of the inspection was explained. Tour was provided. There were children present during the inspection.

Census was taken. There were 26 children with 5 staff members.

IB investigation consisted of interviews conducted with Director as well as persons related to the incident. Review of video footage, medical reports, unusual incident reports, daily schedules, staff schedules/roster, contact information, and staff behavior management policy were reviewed.

Complainant indicates that staff physically assaulted a day care child, resulting in injury requiring medical.

Based on investigation from IB, Staff #2 did not have intention of hurting Child #1 during the incident that took place.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.

Based on information obtained during the IB investigation, Child #1 (C1) ran away from the rug area of the classroom. Staff #2 (S2) saw C1 running and got up to grab their left hand. S2 continued to hold C1’s hand, when C1 dropped to the floor, dragging them on the floor. S2 admitted to holding C1 higher the subsequent time they dropped to the floor. S2 disclosed that they grabbed C1’s hand hard but without malice. C1 has had a history of dropping their weight. This act of neglect from S2 in how they responded to C1, resulted in a dislocated elbow (Nursemaid Elbow).

Video footage reviewed confirmed disclosures and statements by Staff and persons interviewed during the investigation. During footage review, S2 was observed not noticing C1 fall to the floor, as they held their hand, unknowingly twisting C1’s arm.

This was a violation of the facility behavior management and supervision policy, by Staff #2. This neglectful action is being addressed as a deficiency.

Based on LPAs observations and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 Chapter 1 101229(a)), are being cited on the attached deficiencies page.

Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee.

Per Director, there was a staff meeting for retraining onf nursemaid elbow. Meeting went over what happened and how to handle the situation. Separate meeting with Lead teachers were conducted, going over classroom management techniques. Director will send meeting agenda and staff

Based on observation and interview, Licensee did not ensure that Child #1 (C1) was provided the appropriate care, resulting in Staff #2 unintentionally causing injury to C1, requiring medical. This was an immediate risk to the health, safety, and personal rights of children in care.
