32 | Based on information obtained during the IB investigation, Child #1 (C1) ran away from the rug area of the classroom. Staff #2 (S2) saw C1 running and got up to grab their left hand. S2 continued to hold C1’s hand, when C1 dropped to the floor, dragging them on the floor. S2 admitted to holding C1 higher the subsequent time they dropped to the floor. S2 disclosed that they grabbed C1’s hand hard but without malice. C1 has had a history of dropping their weight. This act of neglect from S2 in how they responded to C1, resulted in a dislocated elbow (Nursemaid Elbow).
Video footage reviewed confirmed disclosures and statements by Staff and persons interviewed during the investigation. During footage review, S2 was observed not noticing C1 fall to the floor, as they held their hand, unknowingly twisting C1’s arm.
This was a violation of the facility behavior management and supervision policy, by Staff #2. This neglectful action is being addressed as a deficiency.
Based on LPAs observations and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 Chapter 1 101229(a)), are being cited on the attached deficiencies page.
Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee.
A notice of site visit was given and must remain posted for 30 days.
