On March 13, 2025 at 9:00 am Licensing Program Analysts (LPA) Priscilla Ochoa conducted an unannounced random annual inspection. LPA was greeted by Director, Carylann Oquendo who guided LPA on a tour of the facility. This is a Preschool aged program that operates Monday – Friday from 8:00 am – 5:30 pm. Per Director, there are 36 children enrolled in the program and LPA observe 26 children along with 6 staff members.

This facility is located on the premises of Temple Beth Zion Temple on the 2nd floor of the building which is accessible via the blue door.

At 9:20 am, Director guided LPA on a tour of facility. Prior to parents entering the facility, parents must enter a specific code that is given to them, then they gain entry to the facility. Then parents are able to sign in their child and walk them to their designated classroom. The Preschool program consists of 4 classrooms and a studio room (common area): Fire: 8 children and 2 staff, Water: 2 children and 1 staff, Air: 8 children and 2 staff and Earth: 5 children and 1 staff. LPA did observe 1 volunteer in the Air room who had criminal record clearance. Teacher-child ratios were observed to be in accordance with Title 22 Regulations. Staff names were recorded. All children were observed to be under supervision, including visual supervision. LPA did observe multiple child safety gates on every stair case at the facility. LPA observed napping equipment in the form of mats in the Studio room. Bedding was inspected for good condition, appropriate storage, and cleanliness. Per Director, children take home bedding every Friday for washing purposes and brought back on Monday. There are age-appropriate toys and supplies for children in each classroom and are in good repair. Each child was observed to have their own cubbie to store personal belongings. All toilets and hand washing facilities are in safe and sanitary operating condition. Drinking water is available in form of personal water bottles that are also taken outside when needed. The facility provides additional water which is dispensed in each classroom for children in care.

The classroom furniture and equipment were inspected for good repair, free of sharp, loose, or pointed parts. All indoor classrooms were inspected to ensure that the floors have a surface that is safe and clean. All materials and surfaces accessible to children are toxic free.

The facility does have an active waiver that was granted by the department for outdoor use, since the play yard does not accommodate 45 children at one time. The department has granted the facility permission to have a staggered play schedule to ensure all children have outdoor time. The outdoor playground for children in care was observed and fenced. Outdoor playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All areas around or under high climbing equipment, swings, slides, and similar equipment are cushioned with material that absorbs a fall. There is adequate shade in the play yard.

At this time, the director’s office is used as an isolation area when a child becomes ill while parents are contacted. There is also a mat available if needed.

The facility provides am and pm snack for children in care. LPA reminded the director, food that is brought from home must be labeled with the child’s name, stored properly and or refrigerated. There is a small kitchen on site and was observed to be clean, and the cleaning compounds/solutions were found to be away from the food. Storage areas are clean, free of litter, rubbish, and rodents/vermin. All storage containers for solid waste, including moveable bins, have tight fitting covers on and are in good repair. Disinfectants, cleaning solutions, poisons and other items that are dangerous to children are stored in an area inaccessible to children. The facility takes measures to keep the facility free of flies, other insects, and rodents. Per Director there are no weapons, firearms, or bodies of water on the premises.

The Licensee is within the conditions, limitations, and capacity specified on the license. LPA did not observe the following items to be posted: License, Notification of Parents' Rights (PUB 393), Personal Rights (LIC 613A), PUB 269, Daily Schedule, and snack menus. LPA did observe Child Passenger System Poster to be posted upon entrance of the facility.

LPA observed a smoke/carbon monoxide detector but was not functional.

LPA observed a 2A-10BC fire extinguisher. The valve on the fire extinguisher was pointing to the fully charged green section but had not been serviced since 03/03/2023. Director stated that the fire department had not come to service them yet. LPA reminded Director, that fire extinguishers must be serviced yearly. Emergency disaster drill was last conducted on 01/23/2025.

This facility uses the Bright Wheel application to sign in/out children and communicate with parents. LPA reviewed Sign in and out sheets to ensure that the person who signs the child in and out uses their full legal signature and records the time of the day.

Children’s Records were reviewed to ensure that Identification and Emergency form and a medical assessment are on file. Child records were deemed not complete. 1 of out 5 children files reviewed did not have a medical form from the parent providing consent and instructions on how to administer their prescribed medication. LPA reminded the Director that the medication must in its original box and with its original label with the child’s name on it. LPA provided Director LIC 9221 for guidance. 1 of 5 children did not have immunization records for LPA to review.

Staff records were reviewed to ensure Criminal Records Clearance for adults and verification of CPR/First Aid and health preventative practices documentation. Staff records were deemed not complete. During file review LPA identified 3 out 6 staff members did not have criminal record clearance. LPA discussed with Director what was discovered. LPA and Director both logged into the Guardian website and confirmed that 3 of 6 staff did not have criminal record clearance. LPA observed all 3 staff leave the premise. LPA reminded the Director, all staff must obtain criminal record clearance before returning to the facility. 3 out of 6 staff did not have immunization records, 3 out of 6 staff did not have current Mandated Reporter Certificate training, 1 out of 6 staff did not have educational transcript for LPA to observe.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. Director could not provide proof that the facility has been tested for lead. LPA reminded that Director that lead testing my be completed every 5 years. LPA suggested that the Director look over: Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP

LPA advised the licensee to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA P. Ochoa informed Director, Carylann Oquendo that this report dated March 13, 2025 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA P. Ochoa informed the Director, Carylann Oquendo to provide a copy of this licensing report dated March 13, 2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Based on the LPA’s observations and record review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

A notice of site visit was given and must remain posted for 30 days during facility’s hours of operation. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview was conducted, and a copy of the report was provided to Director, Carylann Oquendo.
