32 | According to the Reporting Party(RP) regarding the allegation that staff were operating out of ratio, the RP stated that while she was present at the facility, she remained attentive to staffing levels to ensure ratio requirements were maintained. RP reported that when there were insufficient staff available, all children would be combined into one group under the available staff to maintain the required teacher-child ratio.
Regarding the allegation staff yell at children, there was one specific staff member that RP observed to be yelling. RP states, “staff has a very strong voice and him raising the voice to get kids attention in the classroom, well there’s an echo in there so his voice getting louder it just sounded loud, it was yelling to me”. RP reported (speculating children’s behavior) “why are you yelling”, like a question in their head or something”.
Regarding the allegation that staff yell at one another in front of children, the RP stated that Staff #3 yelled at her in the presence of children. RP did not report observing staff yelling at other staff members on any occasion.
Parent interviews made no disclosures pertaining to the above allegations. All parents reported not having any concerns regarding the facility. Parents further reported they have not observed staff yelling at children nor at each other.
Child interviews did not disclose any information to corroborate with the above allegations.
LPA observed the facility to be in compliance with the required staff-to-child ratios. All children were observed to be in their assigned classrooms and/or groups in supervision.
Based on interviews, observations and disclosures made during the department investigation, no disclosures were made by staff, parents or children pertaining to the allegations above. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
A notice of site visit was given and must remain posted for 30 Days. Appeal Rights were provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
Exit interview was conducted and report was provided to Marline Esquivel Program Manager and Mathew Martinez Site Director. |
