32 | Administrator stated that a client is the one who is recording and posting the clients on social media. Administrator has posted signs through- out the facility to indicate recording of clients in care is not allowed. Interviews with clients in care revealed that C2-C7 that they are aware of the facility’s camera’s in the common areas, and that they do not have an issue with them, and don’t feel that they are being inappropriately recorded. Clients C2-C7 stated there are no cameras in their bedrooms or bathrooms. RP/C1 stated that they are not recording clients with out permission, and not posting on Social media.
LPA observed Cameras in the dining/living room and hallways, front entrance. Lpa did not observe clients being recorded and posted on Social Media.
Based on Interviews, Record Review, and Observation the Department finds that : “Although the allegation may have happened or is valid, there is not preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.”
Regarding Allegation: Staff make inappropriate comments towards resident
RP/C1 stated that staff are making inappropriate comments towards residents. Interviews with C2-C7 Generally stated that they have not had any comments made towards them, that they feel are inappropriate. C2-C7 Generally stated that they feel that staff treat them with respect, and have no issues. C2-C7 have not witnessed inappropriate comments towards other clients in care.
Interviews with Administrator, and Staff 1, and Staff 2 generally stated that they speak respectfully to all clients. Administrator stated, that she tells one particular client, ”that they cannot film other clients in the facility, and when the client gets upset, that she disengages by walking away. She does not go to the same level of emotion as the client.” LPA did not observe any Inappropriate comments towards any client in care.
Therefore; based on Interviews, Record Review, and Observation the department finds that “Although the allegation may have happened or is valid, there is not preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.”
No citations issued during this visit, and exit interview conducted, and a copy of this report was provided.
