On 11/2/23 Licensing Program Analyst (LPA) Felisa Shirley conducted an unannounced complaint visit to the address listed above. LPA and LPM arrived at 8:44 and spoke to Administrator, Joy Suarez and the purpose of the visit was discussed. LPA was granted access to the facility.

The investigation consisted of the following: On 11/2/23 LPA reviewed and requested copies of the following records: Staff files, resident files, Staff and Client rosters, toured the facility interviewed both staff and clients.

Allegation: Staff yelled at resident
On 11/2/23 at 9:15am LPA Shirley and Administrator, Joy Suarez toured the facility. At 9:50am, LPA conducted interviews with both staff and residents. At 10:30am, LPA Shirley reviewed facility files. During file review, found there to be no evidence of harassment, nor write ups for mistreatment of clients in care. LPA interviewed all staff, staff 1 – staff 8. LPA ask, “Does staff yell at the clients?”, and 8 out of 8 stated no. LPA interviewed one client, C-1, as the other three residents, (C-2 to C-4), are non-verbal. LPA ask resident, “Does staff yell at you?” The client answered no.

Based on information gathered, the department did not find sufficient evidence to support allegations "Staff yelled at residents.” Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Allegation: Staff leaves hazardous chemicals out accessible to residents
On 11/2/23 while LPA Shirley and Administrator Joy toured the facility, LPA did not observe any type of hazardous chemicals accessible to residents. During the inspection, the administrator located and unlocked all cabinets containing cleaning supplies and chemicals to show that alleged items were locked away from persons in care. LPA interviewed all staff, staff 1 – staff 8. LPA ask, “Do you lock up hazardous chemicals?”, and 8 out of 8 stated yes. LPA ask C-1, “Have you observed hazardous chemicals or had access to hazardous chemicals?” Client C-1 stated no.

Based on observations and interviews, the department did not find sufficient evidence to support allegations "Staff leaves hazardous chemicals out accessible to residents.” Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Allegation: Staff leaves sharp objects out accessible to residents
On 11/2/23 while LPA Shirley and Administrator Joy toured the facility, LPA did not observe sharp items accessible to residents. During the inspection, the administrator located and unlocked all cabinets containing sharp items to show that alleged items were locked away from persons in care. LPA interviewed all staff, staff 1 – staff 8. LPA ask, “Do you lock up sharp items, such as knives, scissors, and razors?”, and 8 out of 8 stated yes. LPA ask C-1, “Have you observed sharp objects that were not locked up?” Client C-1 stated no. Upon file review and a review of an incident report submitted, there are no reports of injuries from sharp objects from this facility.

Allegation: Staff sleeps in resident’s room

It was reported that the staff sleeps in the residents room. On 11/2/23, interviewed staff-1 – staff-8 (S-1 – S-8). LPA ask, “Do you sleep here at the facility?” Of those interviewed, 8 out of 8 indicated no. All staff responded that no one sleeps in the facility. LPA interviewed resident 1, C-1. LPA ask, “Does any staff member sleep in your room?” Client responded, no.

Based on interviews, the department did not find sufficient evidence to support allegations "Staff sleeps in residents room.” Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was conducted and a copy of the LIC 9099 was provided to Administrator Joy Suarez.
