This complaint inspection was conducted by Katrina Chicote, Licensing Program Analyst (LPA) on 10/26/2022 at 11:05 AM for the purpose of initiating the10-day inspection. Upon entrance of the home, LPA was greeted by A1, Licensee's Assistant, who has criminal record clearance. Licensee arrived at the facility 11:08 AM, and LPA advised Licensee of the purpose of the visit and the above allegation. A1 assisted in translation as Licensee is Native Spanish speaker. There was initially four children present, one of which was an infant, and three additional children arrived at 11:10 AM totaling seven children present during today's inspection.

During the investigation LPA observed A2, to come out of off limits bedroom upon arrival and was present at the facility during inspection. Interivew with A2 states that he does not live in the home but is at the facility due to his car not being operable. LPA viewed A2 go to a blue vehicle multiple times that was parked on facility's driveway. LPA viewed A2's California Identification Card and observed that A2's address is facility's address (photo was taken).

Based on the available information, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

Licensee (or facility representative) was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The following citations are being cited today on the attached LIC 9099D and Civil Penalty assessed.



Upon receipt of this report, the Licensee shall post the Notice of Site Visit and any Licensing report documenting a type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement of Receipt (LIC 9224 form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee states she will obtain criminal record clearance or exemption for A2 and until then A2 will not be present at the faciilty when daycare children are present. LPA obtained written declaration at time of inspection. Clearing deficiency on this date.
