On 9/5/2024 at 12:00 PM Licensing Program Analysts (LPAs) Claudia Kam and Joshua Ortega conducted an Unannounced Required 3 year Annual inspection to the above facility. LPAs disclosed the purpose of the inspection and met with Licensee, Kelly Luckey who guided the LPAs on a tour of the facility.

There are 2 adults living in the home. All adults in the home were found to have criminal record clearance. Licensee states that there are currently 17 children enrolled. The children's roster was reviewed and is current. During the inspection, 10 children ( 3 infants, 7 preschool age) 2 assistants, licensee and one adult were present. LPAs observed 10 children napping. 2 infants ages 14-18 months were sleeping inside a playpen individually labeled for each child. 2 infants were in individually labeled swings and were observed moved once asleep. Documentation of sleep log is conducted on Bright Wheel app and reported to parents. The preschool children were sleeping in individually labeled cots and bedding. Licensee provides and washes all linens. Licensee reports that the facility’s hours of operation are 6:00 AM to 10:30 PM, Monday thru Friday. Emergency Disaster Plan, License, and Parents’ Rights were posted at the time of inspection. Per Licensee, disaster drill was last conducted on 7/23/2024 and drill log observed.

This is a two-story home which consists of three bedrooms and one and a half bathroom, kitchen, living room, family room, garage, front yard and backyard. Areas used by the children include the living room, downstairs half bathroom, and family room. Family room will be used for isolation of sick children and infant children moved to living room till pick up. Per Licensee, areas off limits to children and parents include all of upstairs, garage and side and backyard. LPAs observed that there is a baby gate at the bottom of the stairs making the second floor inaccessible, garage and side gate are maintained locked during care hours. All were observed locked at time of inspection. Per licensee, off limit bedrooms are kept closed during operating hours.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children.

Main Care Area for the day care children is located at the entry of the home in the living room and is equipped with cubbies for personal belongings, cubbies with toys, large child size tables and chairs, per licensee she uses curriculum from Lillio for preschool children which provides activities and materials.

The family room is used for infant care only and the infants are separated from the preschool and school age children via a baby gate at the entrance to the family room. There is a large play pen with soft washable toys for infant play and a large rug for tummy time. All staff and adults remove shoes prior to entry to ensure cleanliness of the area. LPAs observed an A/C unit and fans in the living room and den of the home. There is a working telephone maintained in the home.

Per licensee, the children will have access to the front yard for outside play. LPAs observed yard adequate perimeter fencing through-out the property. There are gates to prevent access to the side gate and attached back yard. The area was observed to have a play house, tables, water table, infant slide, ride on toys, and play structure with artificial turf throughout the area. LPAs observed yard to be free of loose and sharp parts available for the children in the yard and to be well maintained.

The valve on the required 2A 10BC fire extinguisher indicates fully charged, service date reflects date of 5/13/2024. LPA checked Smoke and carbon monoxide detectors are in operable condition at time of inspection. Hazardous items including poisonous materials are not kept in the home. LPA observed First Aid kit kept on shelf in Main Care Area and was inventoried for necessary supplies. Licensee provided proof of immunization against influenza, pertussis, and measles during today’s inspection. Licensee has current mandated reporter training and cpr.

—Children records and required licensing forms were discussed as well as mandated child abuse reporting and criminal record clearance requirement.

Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPA did not observe any bodies of water around the premises at time of inspection. Per licensee, they provide food for children in care. Licensee provides breakfast, lunch and am and pm snacks. Menu observed posted for the month. Food preparation area was toured and found in compliance for safety, cleanliness, and proper storage.

LPA reviewed with licensee the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the licensee.

Licensee Kelly Luckey was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.



This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. For IMS information see PIN 22-02-CCP.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today 09/05/2024.

A notice of site visit was given and must remain posted for 30 days.
