Licensing Program Analyst (LPA) Ashley Calderon conducted a subsequent visit to deliver findings for the above complaint allegations. LPA upon arrival met with Staff Assistant Joquna Coulter who allowed LPA entrance into the home. LPA disclosed the purpose of today's visit.

Staff J.Coulter called Licensee Kelly Luckey to inform them of LPA's presence. LPA observed 10 children with 2 staff assistants; both were fingerprinted cleared and qualified. LPA conducted a tour of the facility alongside J.Coulter. During today’s visit LPA interview staff #2. LPA Calderon attempted to interview children Child #3- Child #5. Licensee Kelly Luckey arrived at approx. 9:57am.

Based on interviews conducted, record review and observations the following allegations are unsubstantiated.

Allegation: Staff did not prevent children from inappropriate interaction.
Per LPA Dayna Chambers interview with Staff #1 (S1) who was with the children at the location were the alleged inappropriate touching occurred, staff #1 informed LPA Chambers they did not observe any inappropriate touching occur by child (not a day care child) to child in care (Child #1) at the park, S1 mentioned were visually supervising from two feet from the children playing on grass and when Child #1 (C1) parent called them to inform them what their child said what occurred, S1 asked C1 about the incident and C1 replied with ‘Huh’. Licensee during interview with LPA D.Chambers stated obtained permission to take Child #1 and Child #2 to the park for Staff #1 daughter’s cheer practice and Licensee was not present at the park, although Staff #1 told the Licensee that on the day of the cheer event Staff #1 received a call from Child #1 (C1) and Child #2 (C2) parent stating Child #1 told their parent that a boy inappropriately touched Child #1 and Staff #1 immediately told Licensee about the incident and Licensee addressed the situation by calling the parent to speak to them but they refused. LPA Calderon did 3 attempts to interview Child #1. During visit 4/3/26 LPA Calderon attempted to interview Child #3- Child #5 who were present at the park, children were not at the facility during this visit.

Allegation: Staff did not provide a safe environment for children in care.

Staff #1 during interview with LPA D.Chambers denies not providing supervision to the children. Per interview LPA D.Chambers had with Licensee K.Luckey Child #1 and Child #2 parent gave consent to take children to an off site party and LPA Calderon received a screenshot of parent conversation on Brightwheel App of parent giving consent on 10/14/25 for children to attend party. Reporting Party states individuals were smoking at the party, Licensee during interview with LPA Chambers that they did not attend off site events like the park cheer practice outing or the offsite kids party although stated if staff was to observe anything unsafe, they would immediately address the situation but smoking in front of the children Licensee didn’t observed and stated it has never happened. LPA Calderon on 4/3/26 conducted a tour of the facility and during visit LPA did not observe any hazard/ risk to children and facility was free of smoke smell and observed facility was safe for the children in care.

Allegation: Staff do not assist child with toileting

Per LPA D.Chambers interview with Licensee K.Luckey informs LPA that they assist in potty training, and before children leave the facility they ensure they are dry. In addition, LPA Calderon observed diaper logs for child #2 from Brightwheel app from dates Sept 25’ – Nov 25’ and LPA Calderon reviewed text message screenshots of conversations that Licensee had with parent of a child #2 who was having potty training issues (urinating self), per messages Licensee shows Child #2 uses the potty when prompted; however the child does not independently initiate toileting needs; there were inconsistency of assisting Child #2 with toileting needs as they weren’t reminded at all times. LPA Calderon during visit on 4/3/26 observed a diaper changing station, cubbies for each child who receives potty training / diaper changes with diapers and wipes, picture taken. LPA Calderon did 3 attempts to interview Child #2. One parent interviewed informed LPA Chambers they child gets diaper changes and is satisfied with the service.

Allegation: Staff had a verbal altercation while in the presence of children

Interview with Licensee Luckey and LPA Chambers indicated that Child #1 and Child #2 parent were at the Elementary school picking up their child at the same time day care staff were there and Licensee was present for the second occurrence only were parent of C1 and C2 were aggressive and yelled, “I don’t care” to Licensee and Staff #2 (S2). Per Licensee, altercation occurred outside of the day care premises by the parent of C1 and C2 who reacted aggressively towards the staff due to unhappy that Licensee removed C1 from the school permit that C1 was using with the facility address. LPA Dayna Chambers attempted to interview Principal who was present at the school where alleged verbal altercation occurred. During 4/3/26, S2 informed LPA during interview was not involved in the altercation and parent C1 and C2 and another individual that was with the parent came at S2 and the Licensee yelling things like “you don't scare me and I am going to jump you.” S2 stated was there to pick up other day care children.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore, the allegation is unsubstantiated. Appeal Rights were provided and a notice of site visit was given to post for 30 days.

An exit interview was conducted with Facility Representative Tiera Ross and Joquna Coulter.
