On 9/27/24 at 9:45 am Licensing Program Analyst (LPA), Claudia Kam and Joshua Ortega made an unannounced required visit at above licensed facility. LPAs disclosed the purpose of the inspection and was granted entry into the facility.

LPAs met with Director Peyton Solomon and was taken on a guided tour of both indoors and outdoors of the facility. LPAs observed Teacher-child ratios, and staff names recorded. All center staff that was present during today’s inspection had fingerprint clearance 1 of 4 staff was not associated to the designated license number but was corrected during visit. Care and supervision evaluated it is determined that the basic needs and personal rights of children are met and appropriate.

The hours of operation are 6:00 am – 6:00 pm, Monday - Friday. Facility is currently licensed for a capacity of 24. At the initial start of the site visit, there is a total census of 4 children and a total census of 2 teachers present. The facility is made up of 1 classroom. LPAs observed all posting requirements for operation on the posting board and the following documents were observed LIC 203A-License, LIC 610 A-Emergency Disaster Plan not posted, LIC 9148-Earthquake Preparedness not posted; PUB 394-Notification of parent’s rights poster, LIC 613A- Personal Rights, PUB 269- Child Car Seat Law, Menus, and Activity Schedule were observed.
Furniture and equipment were inspected for age appropriateness and good repair. Telephone service, heating, lighting, and ventilation were evaluated. Children's napping equipment met the requirement regulation at time of inspection. Storage for children's belongings, bathrooms facilities, and isolation areas were inspected. There are no age-appropriate sinks and toilets or potty training toilets as per director they do not potty train at the center. LPAs observed cubbies with plastic toys for developmental play, one bin for infant toys as per teacher they only have one infant. The toys were observed to be clean and free of hazards at time of inspection. LPAs observed carpets and play area. The open floor plan only has rugs for rug time. There are no age-appropriate tables and chairs in each classroom. Page 1 of 5

Director will be installing a barrier for the cribs to separate it from the play area. LPA observed a small first kit kept in the classroom. First Aid supplies were inventoried and were found to be in compliance with regulation.

Facility provides breakfast, snack and lunch, menus were reviewed at time of inspection. All food items delivered daily to the facility by their preschool license facility. Food items brought in by parents were observed to be shelf stable and individually labeled and dated for each child. Food and snack items are properly stored. Food preparation area was toured and found in compliance for safety, cleanliness, and proper storage. Drinking water is provided via bottled water service. Carbon monoxide detectors were not present. Smoke detectors are present in the facility. LPAs confirmed detectors at time of inspection and were determined to be in operable condition. Fire extinguishers were observed as serviced on 12/3/2024. No fire drill log present for observation.



At 10:00 AM, LPAs observed outdoor play area which consists of a tented area and open air area. Outdoor equipment was inspected for safety, cushioning material, good repair, and age-appropriateness. LPAs observed with a toddler slide and infant slide, and a play house, there was a second playhouse outside of the shaded area and ride on toys, play structure with a plastic slide, and other age-appropriate toys around the play yard. Required shade and fencing were inspected. Dumpster observed in outdoor play area without any barrier to make it off-limits to children, play area is not enclosed. LPAs advised Director that the children need to be always within the direct care and visual supervision by the teachers. Per Director, the children have access to drinking water via a water dispenser and their personal cups or bottles depending on age of the child. Play area was inspected for hazards and inaccessibility to bodies of water; no bodies of water or hazards observed at time of inspection.

LPA reviewed with director the LIC 311A, Records to Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted. Staff and Children’s Records were reviewed. Criminal Record Clearances were reviewed for adults. LPAs observed current CPR and First Aid Certification for center staff. CPR card expires on 9/2025 for Staff Member. Child files 3 of 4 did not have sleep plan, or infant needs and service plan.

Mandatory Forms for the children’s files and staff files, requirements for fire drills, earthquake drills and documentation were discussed. Role and responsibilities of being a Mandated Reporter were reviewed.

The Director was advised how to access forms and Regulations online at www.ccld.ca.gov. to ensure the most current information regarding regulations for all those who assists in providing care at the facility.

The following were discussed with the Director:
The fire extinguisher type 2A-10BC must be serviced annually or as often as necessary. Smoke and Carbon Monoxide detectors should be checked, and batteries replaced as needed. Changes should be reported to the Department as soon as they occur such as construction, remodeling, telephone number changes and/or if you move from your location. The Director was also advised of the requirement to report Unusual Incidents and/or injuries to the parent/guardian and to CCLD within the time frame specified by the regulation.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Center was reviewed for lead compliance and center meets standards for lead. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice) or (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA are available at: https://www.ada.gov/resources/child-care-centers/.

Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.


Based on this information the following deficiencies on the LIC 809 D are being cited today 9/27/24.

LPA Claudia Kam informed facility representative Peyton Solomon that this report dated 9/27/24 documents 1 Type A citations which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Claudia Kam informed the facility representative to provide a copy of this licensing report dated 9/27/24 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A violation regarding no carbon monoxide and warrants an immediate civil penalty of $500.00 and is hereby assessed, see LIC 421IM or other form used.

A notice of site visit was given and must remain posted for 30 days.
