32 | observed licensee redirect a day care child to another play area outside, by going over to the child, kneeling in front of the child, and explaining instructions in a calm tone. Then taking the child by the hand and leading them to the area for the child to play.
LPA White conducted interviews with parents, staff, and LPA Kam attempted interviews with six children. Interviews conducted with parents revealed that none of their children have ever disclosed that Licensee Nely or staff have been mean to them, nor do they feel that Licensee Nely Salazar is harsh towards their children. Interview with staff #2 revealed that the children are always given many opportunities to correct their behavior. Staff #2 states that she helps the children remain calm by giving them different activities. When a child is very upset, Staff #2 states that she rocks them in her arms to soothe them.
Based on interview with Licensee Nely Salazar, she disclosed that she sought the help of the referral agency for the child involved in the allegation. Licensee states that she was given resources from the caseworker to pass on to the mother, but parent chose not to speak with Licensee. Licensee states that Ms. Addie instructed her to give the child breathing activities when he becomes upset. Give him a few moments to calm down before trying to talk to him. Licensee states that she was given resources from Ms. Addie, Specialist for Allies for Every Child Licensee states that she never left the child indoors unsupervised while the other children were outdoors playing. Licensee states that she and her staff alternate responsibilities to the children based on the amount of children still napping in the afternoons. Licensee states if the child were crying, he would've been taken outside instead of left indoors. Interviews with the children were conducted with LPA Kam, because the children are majority Spanish - speaking. However, given their ages there was no viable information collected from the children.
Regarding the allegation of Personal Rights - licensee utilizing unusual punishment by leaving a crying child indoors while taking the other children outside for play time, that allegation is UNSUBSTANTIATED. This means that there is not enough of a preponderance of evidence to support that it did or did not occur.
Based on observations, interviews, and record review, there will be no deficiencies cited today in accordance with California Title 22 regulations.
