Licensing Program Analyst (LPA) Franchesca White arrived at the above facility for the purpose of an unannounced Annual - Random. LPA White announced the purpose of the visit and was granted entry into the facility by licensee Nely Salazar. The hours of operation are Monday - Friday 7:00 - 7:00 p.m. The ages of children served at this facility are infant to 7 years of age. There are 13 enrolled in the facility, and 4 present at the time of inspection. The Parent Board was observed to have the following documents: The facility roster was available and was current. The Disaster Drill Log was available with the last drill conducted 7/21/2025.

This is a single story home with three bedrooms, two bathrooms, living room, dining room, kitchen, front yard and back yard. Areas available to children and parents are Bathroom 1, Main day care space located at the rear of the home, and back play yard and driveway. Areas off limits to children and parents are all three bedrooms, and the kitchen that is only a walk through space to the children's eating and napping space in the home. All areas on the facility sketch were inspected for the health, safety, heating and ventilation of the children in care. Licensee was reminded that off limits areas are subject to inspection in accordance with California Title 22 regulations.

All life saving devices were inspected and operable at the time of inspection. The Carbon Monoxide Detector, and Smoke Detector are located in the living room, children's dining space, and the main care area in the rear of the home. The 2A 10BC fire extinguishers are located in the hallway, and outside. Both have a service tag dated 3/21/2025. There is a first aid bag hanging near the fire extinguisher in the hallway. Licensee states that the outdoor shaded area is used as a isolation space for sick children waiting to be picked up by a parent or guardian.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPA White observe the Living Room and Dining Room to have a large sectional couch, a recliner chair, and a dining room table for six to sit. This space is inaccessible to children in care with the use of a gate that sections off the dining and nap area for day care children. This space has a table and chairs for day care children. There are individual activity seats for pre-school children to sit and have their meals. There is a bedroom to the left of the entry of this space that is made inaccessible to children in care with the use of a child safety lock.

LPA White observed the kitchen is a walkway to the rear main care space and has been made safe for the children in care with the use of child safety locks on the cabinets. The knives are stored up high in a locked cabinet making them inaccessible to children in care. Licensee states that she cooks the meals for the children in care.

There are gates to each space in the facility to ensure the safety and supervision of the children throughout the home. LPA White observed the bathroom to the right of the hallway through the laundry space. LPA White observed the bathroom to have one toilet, one sink, and a shower. There were no flooring hazards, or debris. LPA did not observe any chemicals. Bathroom was clean.

LPA White observed another bedroom mad inaccessible to children in care with the use of a child safety lock on the door. LPA White observed the main care room to be filled with age-appropriate toys, books, puzzles, storage shelves filled with activities for the children in care. There is a book reading area with soft sitting space for the children. There is a door to the right that leads to the outdoor play space.

LPA White observed the outdoor area to have ample shaded space with a total fenced perimeter for the safety and supervision of the children. The outdoor play space has painting and activity supplies. There is a bathroom outside for the children with one sink and a toilet for the children. There a bikes and a long driveway for the children to play. There is a writing station for the children complete with a table and five chairs. There are dramatic play areas for the children with posting of the children's art work on the beams, and walls outdoors.

Licensee states that there are no bodies of water. LPA White did not observe any bodies of water. License states that there are no pets. LPA White did not observe any pets.

Licensee states that there are no firearms or weapons. LPA White did not observe any firearms or weapons.

LPA White reviewed the children's files to have all the required department documents and immunization records in 5 out of 5 files.

LPA White reviewed the Staff file to have all required department documents and immunization records reflective of Proof of immunization against influenza, pertussis, and measles was readily available during today’s inspection. The Licensee did not have current Pediatric First Aid and CPR (expiration date: 1/2025). A technical violation was given. Licensee states that she will provide proof to LPA before the close of business today (7/31/2025). The Licensee has proof of current Mandated Reporter Training Certification with an expiration date of 12/3/2026.

The following was discussed:
All areas used by children were inspected for safety, comfort, cleanliness, telephone service (cell phone), ventilation and heating (central air and heat).

Licensee Nely Salazar was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee Nely Salazar and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee Nely Salazar of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee Nely Salazar was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee Nely Salazar, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Based on today's observations, record review, and interviews there are no deficiencies cited in accordance with California Title 22 Regulations.

A notice of site visit was given and must remain posted for 30 days. Failure to post will result in a civil penalty of $100.
