On Thursday, February 3, 2022 at 9:45 AM, Licensing Program Analyst (LPA) Mayra Rivera conducted a pre licensing inspection and met with director Diane Bernstein and administrator Dr. Ashley Wiley who guided LPA Rivera on a tour of the facility. Due to Covid 19 precautionary measures were taken during the entire inspection and all individuals present during this inspection wore appropriate personal protective equipment.

This is a proposed speech and language therapy program. This program will serve children ages 18 months years to 4 years. This program will operate Monday - Friday from 8:30 AM to 4:00 PM. Sign in and out will be taking place at the main entrance lobby area.

All areas identified on the facility sketch were toured both indoors and outdoors; measurements were taken. The applicant is seeking to provide services for toddlers and preschool children. A fire clearance has been granted as of January 21, 2022 for 30 children.

At approximately 9:50 AM LPA entered the classrooms to conduct an inspection and measurements. LPA observed age appropriate furniture and equipment in good condition, free of sharp, not loose, or pointed parts and age appropriate toys accessible to children. LPA observed step trash bins with a tight-fitting lids.

Heating lighting and ventilation were evaluated by LPA. LPA observed central AC/heater and vents located on the ceiling wall. LPA observed the thermostat located in the hallway and the current room temperature to be at 66 degrees LPA observed the fire extinguishers located in the hallway and the valve on the required 2A10BC fire extinguisher indicating fully charged and purchased receipt dated October 6, 2021. Smoke detector and fire alarm are located in classrooms on the top ceiling and connected to the pull down alarm. LPA observed carbon monoxide alarm located in the hallway and LPA did not see the green light flash nor heard the sound of the alarm. LPA advised to replace the carbon monoxide alarm. The cubbies located in the hallway will be utilized for children personal belongings.

At approximately 10:20 AM LPA Rivera observed the restrooms to be in good condition with working toilets, sinks, hand soap dispenser and paper towels. LPA observed a total of 2 toilets, and 2 sinks. Restrooms are located in the hallway. LPA did not observe napping equipment as this program is only half time. For ill/isolation area children will utilize the quiet room and a mat will be available for children to rest if needed and the staff restroom located in the hallway. will be utilized. LPA observed first aid kits inside the kitchen cabinet and were observed to contain the required first-aid supplies. LPA observed the cleaning supplies stored in the kitchen inside the top cabinet making it inaccessible to children to reach. LPA did not observe any poison items. LPA informed any poisons (ex; drano, rat poison or items with skull hazard symbol), is required to be locked with a key or combination lock.

This program will provide AM and PM snacks. The snacks will be prepared on site. A monthly snack menu is available and posted in each classroom. For water drinking the facility will be providing water pitchers and disposable water cups and also advise parents to bring personal water bottles. LPA observed the food preparation area to be clean and free of litter, rubbish, rodents, and/or any other vermin and storage containers for solid waste, including moveable bins with tight-fitting covers that are kept on, and in good repair. The facility was observed to be free of flies, other insects and rodents.

At approximately 10:40 AM LPA Rivera entered the outdoor playground to conduct an inspection and measurements. LPA observed the equipment to be in safe condition, free of sharp, no loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All areas around or under climbing equipment, are cushioned with material that absorbs a fall. For adequate shade, LPA observed a E-Z UP tent and advised to anchor or place sand bags to ensure the tent does not lift and/or fly out during windy days. For outdoor water drinking, facility will be providing water pitchers and disposable water cups. LPA observed the front and back gates closed. The back gate will remain close and LPA observed a keypad lock in place. The front gate will be utilized for the main entrance. LPA advised to add a child proof lock to make it inaccessible to children to open the door. Behind the dramatic play sink, LPA observed wires hanging. LPA advised to add another barrier to prevent children reaching the wires. LPA advised the administrator hat the children need to be within the direct care and supervision, including visual supervision of the teacher(s) at all times. LPA did not observe bodies of water on the premises.

Director Diane Bernstein has the incorrect pediatric First Aid/CPR certification, missing the preventative health and safety training with the nutrition and lead component, child abused mandated certification (AB 1207) , and immunization against pertussis, and measles. Dr. Wiley has been informed mandated reporter training must be completed every 2 years, and is available at www.mandatedreporterca.com

On the bulletin wall LPA observed LIC 613A Personal Rights, Child Passenger Restraint system poster, LIC 610 Emergency Disaster Plan, LIC 9148 Earthquake Preparedness Checklist, PUB 393 Parent's Rights, Daily Activity Schedule, Menus. LPA observed the Fire/Earthquake Dill log in a binder.

LPA Rivera and Chief Operator Jamie Feliciano discussed Covid procedures. Temperature checks are conducted prior to entering the facility, children wash their hands during drop off, during transitions, after using restroom and before and after snack, Health checks will be conducted daily during drop off, if any symptoms related to Covid child is not allowed to stay and if a fever over 100.4 child is not allowed to come in to the center and a Covid test is required. If child is exposed, child will need to quarantine.

Items discussed during this visit:

1. The following items are prohibited by Licensing: Refused Entry to a Facility or Any Part of a Facility is a violation of Section 1596.852, 1596.853 or 1597.09. Regulations 101238 (g) (2), The Presence of an Excluded Individual, Fire Clearance Violations, Accessible Bodies of Water, Accessible Firearms, Ammunition or Both.
2. Breakfast/Lunch/Snack Menus: Menus are required to be posted one week in advance where it is visible by the child's authorized representative. Menus for the past 30 days must also be available upon request.
3. Current Children’s Roster: Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.
4.LIC 311A - Records to be Maintained at the Facility: LPAs advised that forms, regulations and quarterly updates can be accessed on the Child Care Licensing website at: www.ccld.ca.gov.
5.Pediatric First Aid and CPR: At least one person trained in Pediatric First Aid and CPR must be present.

6.Designated Staff: The name of the childcare center director or fully qualified teacher(s) designated to act in the director's absence must be on file.
7.Qualifications: Educational background, training, and/or experience for each staff present must be available for review.
8. Immunization Requirements: Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles
9.Children’s Records: must be available for review; including but not limited to, the following: Name, address and telephone number of the child's authorized representative and of relatives or others who can assume responsibility for the child if the authorized representative cannot be reached when necessary.
10.Incidental Medical Services (IMS): This facility plans to provide Incidental Medical Services – IMS. Criminal Record Statement


Administrator Dr. Ashley Wiley was informed that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Based on measurements taken during today's inspection and 2 toilets and 2 sinks the facility measured for 17 children. To license for a capacity of 29, the facility needs to submit a waiver request. A waiver and a staggered schedule will need to be submitted and reviewed for the 29 children and for outdoor play area..
