On November 10, 2022, at 9:10 a.m., Licensing Program Analyst (LPA) Randy Derraco conducted an unannounced follow-up complaint inspection to the above-mentioned facility and met with Director Claudia Ceballos who guided analyst on a tour of the facility. LPA observed 5 teachers and 14 infants in care. The facility was observed to be clean and in good repair.

During the investigation, LPA conducted interviews, reviewed documents and made observations. On 09/09/22, LPA observed an infant sleeping in an inclined rocker during complaint inspection. Infant teacher advised LPA that the infant had just fallen asleep. LPA observed infant teacher moving infant into a playpen. LPA interviewed infant staff members who indicated that inclinded rockers are used for a few infants to help them fall asleep. Infant teachers state that infants are allotted up to 15 minutes in an inclined rocker before being moved to a play pen. Parent interviewed also states that during pick up, she observed her infant child sleeping in an inclined rocker.

Based on LPA observations and interviews which were conducted and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Subchapter 2- Infant Care Centers, section 101439.1(b) are being cited on the attached LIC 9099D

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted, report reviewed and appeal rights provided with Director Claudia Ceballos. .

Director states she will advise infant teaching staff to not use inclined rockers or swings to assist with napping an infant. Director states rockers and swings will only be used while infants are awake. Director states she will provide a declaration - LIC 855 indicating what infant rockers and swings will be used for and/or remove equipment completely.
