32 | waking up at 1:49 PM. LPAs observed teachers giving awaken infants reading materials during nap time. At 1:55 PM, LPAs observed 3 infants walking around the designated napping area. LPAs observed 14 napping infants, 5 awake infants, and 2 staff members supervising the children in room 2 at 1:55 PM. LPAs also observed staff members walking over napping children on their way to the exit. Spacing between napping infants was observed to not be arranged in a way that prevented staff members from stepping over napping infants. Based on LPAs observations, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, section 101416.5(d) and 101439.1(g), are being cited on the attached LIC 9099D.
LPAs R. Derraco and A. Padilla informed Director, Claudia Ceballos, that this report dated 04/16/24documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPAs R. Derraco and A. Padilla informed the Director to provide a copy of this licensing report dated 04/16/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
