32 | The RP further alleged that it had been two days and the only precaution the facility had taken was to place an orange cone, and that children could easily leave the facility. This claim regarding the sole precaution of an orange cone is partially supported by Staff 2 and Staff 3 confirming the use of a cone (Staff 2 noting its use from 5:15 PM until closing on May 20 and again the next morning, and Staff 3 stating it was used "on and off"). However, staff interviews detailed additional security measures beyond just the cone. Staff 1 outlined their usual procedure of a teacher standing at the pathway during outdoor play to ensure children do not try to get out the gate. Staff 2 also mentioned having a teacher standing by the door to make sure no children got near it. Staff 3 reported the plan was to have eyes on children at all times and that they did limit time for outdoor play while the door was broken. All staff members consistently reported that no incidents occurred as a result of the broken door and specifically stated that children could not easily leave, highlighting their vigilance.
The RP's statement there were no other doors in the facility is consistent with staff accounts that only the front door was used for entry/exit during the incident. However, Staff 1 clarified that while the front door is the usual means of entry, in an emergency, there is a blue sliding gate off the preschool playground that can be opened, and all classrooms have emergency evacuation procedures.
Based upon the review of the summarized interviews indicating consistent staff accounts of multiple precautions taken beyond just an orange cone, and the consistent denial from staff that children could easily leave the facility, there is not a preponderance of evidence to support the RP's full allegation. While a cone was used, it was not the only security measure in place. Staff interviews confirmed that in addition to staff supervision and limited outdoor play, a secondary gate off the preschool playground serves as an additional security measure, and that all classrooms have emergency evacuation procedures. Therefore, the allegation that on May 21st, 2025, the facility's front and only door broke off, and for two days the only precaution the facility had taken was to place an orange cone, allowing children to easily leave the facility, is UNSUBSTANTIATED.
A notice of site visit was given and must remain posted for 30 days.
